Help! My visa and wp dates are different

Hi guys i just found out that my workpermit is expired in september.. i knew my non imm b visa was valid untill late november and now i am affraid what is going to happen

My gf says i need to apply again according to the thai gov website but i found a non gov website that says . The permit will be valid as long as your visa is valid, as in your passport.

Now i dont know what to believe, does anyone of you got the right answer? Many thanks in advance.. regards henk

Do you have a Non-B Visa (valid for 90 days) or an extension based upon employment ?

Hmm i had a short (90 day?) non b first and that got at the end of that period extended with a year or so and that one is valid until end november

When your WP expired you permission to stay (extension) also became invalid. You are currently likely on overstay.

  • Your permission to stay is linked to your WP so when it expired you should have cancelled your permission to stay and left the country, or arranged an alternative permit to stay.
  • Your permission to stay is invalid and you are technically on overstay.
  • Immigration have no way of knowing that your WP expired, but if they found out you would have a problem. You should leave the country (by air) asap.
  • Your permission to stay will end on exit (as long as you don't have a valid re-entry permit) and you can immediately return with a new visa.

I have colleagues who have been in a similar situation. The work permit office has always been sympathetic and issued a new work permit starting from the date the old one expired.

 

I have no idea if my employer makes any offerings to lubricate this sympathetic response.

First important question is - are you still working for the same employer ?

Just one comment: I left Thailand for a new Non-B prior to my previous extension expiring. While I did not have any trouble exiting at a land border (and you should not by air).....when I went to get my extension for this year (new school), the IO took great exception to the fact that I left without cancelling my prior extension. She demanded letters from both my old school and new school before she would approve any new extension. Just be forewarned, they are tightening up ship. Also the Ministry of Labor would not post date a WP cancellation when I tried to cancel on a Friday even though I was leaving the next week. It seems someone has put a bug in them and everything is tighter.
