Questions about citizenship.

Featured Replies

Hi.

I was born in Thailand to a Thai parent and thus assume that I'm considered a Thai citizen. I reside in Australia.

Would it be possible for me to obtain a Thai National ID and passport?

Also if I am a citizen, wouldn't that make my children be eligible for Thai citizenship?

You are a Thai national from birth.

Do you have your birth certificate done here when you were born. You would need that to be registered in a house book in order to get a Thai ID card and then a passport.

You children are also Thai but would need a Thai birth certificates to prove it.

Ubonjoe,

I believe If the Thai parent is the father, they may ask for DNA test, they do not ask this when the mother is Thai,

but in some municipality they do ask it when only the father is Thai and the mother is non-thai.

Thai ID can be obtained only while in Thailand, Thai Embassy would not deliver ID Cards.

Thai birth certificate must be translated in Thai and certified by MOFA or Thai Embassy.

It depends upon which case you are writing about. If the birth certificate is already been done the DNA test would not be needed.

The only birth certificate accepted here to get registered in a house book would already be in Thai. The birth certificate can only issued by the Thai embassy or official consulate in the country where a person was born.

A embassy can issue a ID card if a person is already registered in a house book. What I was writing about was doing it here.

What I refer to is the case where the mother is non-thai, in this case municipalities may ask for DNA test whether birth certificate is from Thailand or not.

Have been overseas for many years with my Thai wife, Embassies always refused to renew or issue Thai ID card they can issue Passports but not ID cards, they do not have the equipment for ID cards, Passports are issued by MOFA Bangkok and sent to Embassy.

Here's the reference from NATIONALITY ACT B.E.2508, regarding the father passing Thai Nationality:

Chapter 1.
Acquisition of Thai Nationality
__________________________
Section 7.6 The following persons acquire Thai nationality by birth:
(1) A person born of a father or a mother of Thai nationality, whether within or
outside the Thai Kingdom;
(2) A person born within the Thai Kingdom except the person under Section 7
bis paragraph one.
“Father” in (1) means also a person having been proved, in conformity with the
Ministerial Regulation, that he is a biological father of the person even though he did not
register marriage with the mother of the person or did not do a registration of legitimate
child.7

An Amphoe should never ask for a DNA test if a birth certificate has already been issued. They might ask for it to issue a birth certificate in some cases.

They started issuing ID cards a few years ago at embassies and official consulates. Info here in Thai on DC embassy website. http://thaiembdc.org/th/บริการกงสุล/บัตรประจำตัวประชาชน/

I'm quite sure I've been included in the Blue House Book and my mother is Thai. I do have a Thai birth certificate so I think that assures it.

Just out of curiosity...are there any pluses to claiming Thai citizenship?  I've heard you can purchase real estate which seems pretty nice for retirement purposes, but I've also heard that if you're a male; you're subject to being drafted into the military.  Any other reasons for a half Thai to apply for Thai citizenship?

You can do everything any Thai can do. No need for visas, extensions work permits and etc.

Unless you here on your 21st birthday the chances are small of being chosen for the draft. At 30 years old you become exempt.

Since the OP was born in Thailand to a Thai parent, he or she should only in theory need to produce his or her Thai birth certificate, although district offices will normally ask for more evidence in the case of Thais showing up from overseas to apply for ID cards.  This is because there are large numbers of people trying to obtain ID cards fraudulently to live and work in the country as Thai nationals.  Getting the details of a Thai of similar age who died or otherwise disappeared is a favorite method.   As Ubonjoe pointed out you can do anything other Thais can, including military service, if you a guy.
