Issues with Landlord and getting a TM30

Through some deceit on the part of the realtors, I ended up not having any documentation on my landlord. I have asked them constantly for this, but they 'say their lawyers do not think this is a good idea'. I have been put in a hard spot because of this. 

 

I needed a TM30 to extend my current visa. I was at a loss, because I could not get documentation, and the landlord was not willing to file one. So, I was lucky enough to be able to pay for the service of the condo owner/manager to provide documents as a substitute for the real landlords. (2000 THB). Then, I was fortunately able to pay for the TM30 (1600 or 1800 thb), both are fees I should not have to pay if I am not mistaken. My landlord has been notoriously unhelpful and I am considering how best to deal with my situation. I am not anticipating my deposit back, as there has been nothing but issues and shadiness, but fortunately my lease is ending soon. What should I do?

very minor penalties for the landlord, less than I was forced to pay and slightly more than the cost of doing it correctly. IT makes sense why so many are putting the burden on the tenant.

Different immigration offices handle the TM.30 requirements differently.

Presumably, you have a written rental contract. This document makes you the "house master", ie the chief possessor of the residence in your capacity as the tenant as defined in section 4 of the Immigration Act and therefore the person qualified to submit the TM.30. Try to make the TM.30 notification online or, if this does not work, by mail.

If it was me I'd just look for a new place when the lease is and you say that will be soon.........."Anything for an easy life and keeping it simple".

Whilst I completely agree with your appraisal of the OP's situation, most Immigration offices still request a copy of the landlords ID card and Tabien Baan for their records, which may be the problem the OP is experiencing.

 

The realtor, acting for the owner, should be fully aware of the law and IMO should have submitted the TM30 completely free of any charges in this instance.

"Naming and Shaming" is a no-no. Defamation and libel issues can be a real mess, especially when one of the parties is a lawyer. 

Go to a lawyer have him write a letter to the owner about this issue Should not cost  you a futune

Usually the reason they do not want to  report to immigration is they are not paying taxes on the money they get from the rent

Make this clear in the letter that funds derived from a rental is taxable

I agree this is best in theory but its not quite practical, it would cost more than the roughly 3,600 baht I have lost to pay for the owners anonymity. The only issue is whether it is worth paying for my last months rent and praying to get some deposit back, or staying and telling them the last month is coming out of t he deposit I do not expect to get back anyways, and if they press the issue use the tax/etc issues as protection.  They have already told me they do not pay tax on it, because ' it is not enough to have to file ' which I know is not true.
