BANGKOK: -- The Central Administrative Court on Wednesday dismissed a lawsuit filed against the industry minister, director-general of basic industries and mining and Thung Kham gold-mining company for negligence of duty in allowing mining operations to proceed, resulting in degradation of environment and exposing people to health hazards.

The lawsuit was instituted to the court by Mr Saravuth Promsopha and 598 villagers of Ban Na Nongbong, Ban Kok Sathorn, Ban Phu Thapfah, Ban Huey Pook, Ban Nonpapoong Pattana and Ban Kaeng Hin of Tambon Khao Luang, Wang Sapung district of Loei province who called themselves the “Homeland Protection Group”.

Claiming that the mining operations had endangered their health and threatened their environment, they demanded to court to revoke the company’s mining concessions and operating license.

Big money has spoken yet again....through the Thai justice system.......aye for the rich and influential.......nay and bugger the poor!

"...The court ruled that the fact that the industry minister and officials concerned did not withdraw the operating license of Thung Kham company did not mean that they were negligent in the performance of their duty..."

Maybe not negligent by the letter of the law in this case - but, there seems to be a history of "official" ignorance when it comes to the villages ongoing battle with this company (http://enlawfoundation.org/newweb/?p=1882).

Seems the are probably plenty of other words that could be applied to these officials.

Let's hope an appeal goes to the Supreme Court.

Sadly,  these so-called officials, want their new years spending gifts...

Interesting the difference between the treatment of this Thai mining firm and the Australian Kingsgate's mine, No?

I bet  the Kingsgate mine will be back in production under Thai owners by the end of 2017....

Claiming endangering health  and stuffing up their environment and then producing substantial evidence  to support the fact are two different things , like most governments suing a Minister of the Junta in this case, you'd be pissing into the wind, exposing people to health hazards you can do that at an airport or waiting for a bus in BKK , the case was brought by the "Homeland Protection Group". Maybe they should confine their protests to protecting Home Land  Democracy, if they want to get into the environment subject, the pollution emitting from the Junta stinks,  that needs fixing, just an idea.......................................................:coffee1:

Ankara is Thai owned and has Thai directors and Thai management , it is a separate identity on it's own from Kingsgate,  money from Ankara doesn't flow back to Australia it stays in Thailand,  it is a Thai run company  for Thai's by Thai's, Thailand has enough qualified mining and skilled  people to carry on operations, but if required specialist opinions can come from Kingsgate or consultants, although a millionaire has approached the Junta with an offer , so far Prayut has ignored this overture

If it's Thai-owned, what's Kingsgate's stake in it?

Seems odd then that Kingsgate's financial statements have Akara as an entity under their direct control, there are two Kingsgate men on the Akara board (one being CEO) and Akara is fully consolidated in the Kingsgate Group accounts in Australia.:whistling:
