Working within the rules of a work permit

Featured Replies

I can find a lot of information regarding how to obtain a work permit but cannot find information regarding working within the rules once you have your work permit.

Immigration don't offer any information when asked but are happy to fine for non compliance and I am told that local immigration offices can in force rules or not as they see fit.

For example:-

I have a company set up with my wife selling real estate and have the required 2 employees who work on split shifts as the office is open 12 hours.

I have been told by the company who obtained my work permit that I should not accompany clients to view property as I can only technically work in the office that is the address in my work permit and should I be seen out of the office with clients that I would be fined.

So if I send out my Thai employee with clients to view property (which is non starter to be honest) I will be left in the office on my own from time to time but I have been told that this is also in violation of the work permit rules and that I must have a Thai employee in the office with me at all times and again I would be fined if inspected and I was on my own.

A catch 22 situation.

Does anyone know if I obtain from the Thai Government a list of the rules and regulations of working in Thailand with a work permit ? although if these rules are applied differently from district to district it would still be difficult to know if working within the rules or not.

Thanking you in advance for any information or experience of trouble in this regard.

That is correct but your work permit could of been issued to state you are required to work at other locations than in the office.

I don't think that is correct. If would depend upon the type of work you would doing while in the office.

There is some info on this webpage. http://www.thailawonline.com/en/business/work-permits/work-permits-in-thailand.html

Thank you for your answers, I cannot have a 2nd address in my work permit as I never know where I am going or to what property.

It was working alone in the office which was my biggest concern as that is where I am most vulnerable

Your work permit can state you are required to work at various locations and they don't have to specified. Your job description would have to state you are required to do that.

A good example of this, but not in your industry are the expats that work on the gas & oil platforms, rigs and fields in Thailand. We travel to many different locations to work and it can change daily or hourly.  Good Luck!!

Immigration has nothing to do with work permits and labour law.

In Bangkok this is difficultq to arrange. I have been trying for 3 years, and so far no luck.

I have additional work places listed on my work permit, but they are all branch offices of the company I work for. To be added to the work permit each branch has to be listed on the company's DBD documents.

I use the following exemption when I am out of the office:

"Based on the opinion of the Council of State, the DOE issued the Notification in March 2015, specifying the following activities not considered as ‘work’ under the Act:
1. Attendance at meetings, discussions or seminars."

I had a business here I closed it due to family illness to return home.

My office was visited oncenter   they found nothing wrong and even checked to make sure no pirated software was on any of the computers.

I was not limited to anything including going out to see clients as long as I had an employee with me. Good luck
