Actions to be taken for navigation obstructing buildings in Thai waters

BANGKOK, 6 February 2017 (NNT) – The Marine Department has set a deadline on 23 February 2017 before pursuing legal actions to buildings that obstruct marine navigation in Thai waters. 

The Marine Department Director-General Sorasak Saensombat has said regarding the enactment of the Act on Navigation in Thai Waters B.E. 2560 that the new law is intended to regulate any constructions overreaching into rivers, canals, seas, or beaches, in an attempt to conserve natural resources and prevent flooding. 

The new law requires owners of overreaching properties who do not have a permit to inform the Marine Department within 22 June 2017 to receive inspection and the decision whether the building will receive the permit or to be removed. 

Constructions that do not comply with the submitted design are also subject to legal action. 

Buildings overreaching into the water mass must be approved via a permit prior to construction. Failure to comply to the Marine Department’s order will result in the construction to be removed. Owners will bear all costs in the removal process.

All the canals seem to be the main target based on the specific mention of the word flooding.  There are lots of extensions of land plots into the canals around Bangkok and probably everywhere else, canal is narrowed which is great until the water flow increases, then the water cannot get away so floods ensure.  Of course can also be used on the walking street structures, sea gypsy camps, hotel swimming pools on the beach etc etc.

 

Will be interesting to see how and where it is applied.

No doubt as we have seen in the past two years, there will be such buildings having permits issued by the authorities which now will be declared illegal due to alleged forgeries, misleading or false information, incorrect property, nonexistent officers, missing documentation, etc.

 

It should be then a judicial matter as to whether building owners are innocent parties to construction of illegal buildings or participants in a corruption conspiracy. A legal process for which the junta has shown little respect, especially if disclosure of information might reflect criminal behavior by parties associated with the junta and its government supporters. If Prayut invokes Art. 44 to remove suspected offending structures, the circumvention of the judicial process would reinforce the appearance of junta complicity.

Er, hold them "sea" horses Sorasak. Before you get too excited, (and as HarrySeaman observes above) maybe you need to refresh your memory - "... The business owners have been issued a 45 day notice issued on 17th April 2015 to dismantle and remove illegal extensions to their buildings..." How's that progressing ???

No doubt, there will be excuses when this deadline lapses too.

 

As they say, "Actions speak louder than words. We can apologize over and over, but if our actions don’t change…the words become meaningless" !!!

We have a causeway that runs parallel to our house, River is about 3mwide and runs a couple of metres down from the top of the bank. Causeway was putin by local government.
