1 year old and 5 year old's VISA

Featured Replies

Hi guys,

A friend (Korean) of mine just moved to Thailand and has obtained Work Permit and a three month Non-B VISA as he works for a Thai company.

Now his family has to get a Dependent VISA, but here's a situation.

- Dependent VISA for family can only be obtained when the husband holds a 1-year Non-B

- His Non-B will be extended to be a 1-year one by 23rd Feb

- But his family's VISA on Arrival will run out 21st of Feb (90 days + extended 7 days)

- The family can do the famous VISA run or visit a foreign country and return to get another 90 days VISA on arrival,,, but

- He's got a 1 year old girl and a 5 year old girl, and the wife is in a really bad health and can't possibly take two kids on a long trip.

Then I have a questions here

1. If the two little ones stay in Thailand without a valid VISA, will it be a problem when they try to get a Dependent VISA, or later an Education VISA?

2. Will the little ones have any disadvantages when flying out of Thailand for overstaying?

I've so far got different answers from other Koreans living in Thailand and Immigration officers as well as VISA agencies.

Some said the little ones have no problem whatsoever while the others telling me the little ones might have some sorts of disadvantages.

So quite confused here....

Thank you for your time and advice in advance.

The problem they have is that they need a non immigrant visa entries to apply for extensions (not a visa)  as his dependents. They could apply for 90 day non immigrant visas (category O) entries at immigration. But immigration will not accept the application while on a the 7 days to leave the country or while on a overstay. Also they would need 15 days remaining on their entries.

From Bangkok Immigration website.

Quote
DOCUMENTS TO BE SUBMITTED IN SUPPORT OF THE APPLICATION FOR VISA OR VISA STATUS ALTERATION (NON-O) TO FULFILL THE DUTY OR RESPONSIBILITY AS AN IMMEDIATE MEMBER OF A FOREIGN FAMILY IN THAILAND.

The application must be submit at least 15 days before visa expiration and, in case of overstaying in Thailand, application could not be submitted.

There only viable options are to go out for new 90 day visa exempt entries or apply for single entry non-o visas at a nearby embassy or consulate.

If the mother could leave for the entry or visa to get her extension the children could go out later since there will no fine for for an overstay. It will not affect them getting visas or extensions later.
