Bull1on Posted March 1, 2017 Share Posted March 1, 2017 Hi there. A friend of mine entered Thailand in mid 2013. He worked for a school till mid 2016. He had a non-imm B visa and work permit. Due to a number of personal reasons. he ended up overstaying his visa for approximately 10 weeks. In mid September 2016 he lost everything (Passport etc.) He went to the British Embassy and they issued him an emergency travel document. They informed him the best thing to do was to go to the Immigration Detention Center, pay a fine and then they would escort him to the airport and put him on his flight home. He did this, although at the airport he was issued with a "barring order" stating that he was barred from entering the Kingdom of Thailand for 10 years because he was arrested (he wasn't he went to the IDC on his own account) and he had overstayed his visa for 1000+ days (he hadn't, as stated he worked for a well known school, who sorted a visa and WP for him) My question to you fine folk is. How would he go about getting this sorted? He wishes to return to Thailand. Does anyone here have any knowledge of similar situations? Or any ideas on where he could start. ubonjoe Posted March 1, 2017 Share Posted March 1, 2017 His only option is to get assistance from a lawyer here to investigate the problem and appeal the 10 year ban. This is also another case of the UK embassy giving bad advice. They should told him to go to airport and pay the fine on departure from the country. I am not sure the banning was done at the airport. I am certain that was done when he went to court. How much was his overstay fine? He could of gone to the airport and shown the police report for the lost passport and immigration would of checked their database for the records of his stay on the his lost passport. I " think " what Ubon Joe was meaning was why didn't he go straight to the airport together with his police report for the lost passport after obtaining the Emergency travel document as opposed to going to IDC, which just is never a good idea. Regardless, I wouldn't listen to a lot of bad advice on here of ways to try and circumvent the system. There is an appeals process but the best way forward legally is with a reputable lawyer who will present the case and not just steal his money. Thai immigration are leaches and I know this first hand many times over. Thailand despises foreigners and are great scam artists because they sit in the seat of power lording over us. Anytime you (Thai gov) would prevent someone well within their legal right from exciting Thailand with ample time on their visa, only to charge them either daily or maximum overstay fines later as a result of them doing that, is an outright immoral crook unworthy of the air God gives us to breath! This has happened to me at on more than one occasion in my 5yrs of being in Thailand. Not only is it not right but, it is inconvenient on ones time and wallet running around like a chicken with your head chopped off from hotel to hotel, Tuk Tuk to Tuk Tuk, & border to border searching for an open door to get yourself right for something someone else should be responsible for. I feel utterly sorry for the bloke because although our situations are similar they both in the end involved the gov dicking us over monetarily or otherwise.. He should call Siam Premier International in Bangkok. Good luck bud but, you'd be better to take the 10yr ban. Thai law is already difficult enough for its citizens because it's a lawless nation to begin with (hence why gays can harass you at work when they could never get away with that crap in the western world due to convenient workplace policies for all) . It'll be harder for you as a foreigner trying to right a wrong. If you don't know, you are not a Thai so everything that comes out of your mouth is automatically a lie to these people and so now it's the government vs.- a civilian in your words as a non-Thai against theirs. Many people take a photo with their phone and or carry a photocopy of the Passport ID page and current stamps, or perhaps the school admin person has some? Any 90 day report receipts? Any online evidence, emails etc.? Tip: I email such copies to myself for safe keeping and also access anywhere there is internet access..... Never lost even if the originals and the phone have gone! Jolly hard luck and then getting bad advice from the Embassy! I would also have done what the Embassy said - why not? They are there to help us are they not? Hi Joe , I have read many of your helpful posts , as have others for sure and I am curious to know how you seem to be the fountain of knowledge regarding Thailand , especially visa questions . Were you once employed in a government capacity or is it simply an accruement of information over the years .
