Hi everyone, first i just wanted to say i have looked through all the previous posts but still couldn't find the answer i needed so thought i would just do the comment, iv had some bad news yesterday and  one of my family members has died and i need to go back to the UK, im married and have been for 12 years and have two boys aged 5 and 8 and want them to travel with me to the funeral and back without mum who is working, i have no time to apply for a visa or UK passport,  they are both entitled to a uk passport given the time as i am british so im wondering what is the potential problems i will face?, is it at the thai end or my own uk end, i have all the paperwork in hand,  marriage, signed mother paperwork, birth certs etc what i dont understand is would this be a problem, their my kids travelling with me, they have thai passports and i have a uk passport, can this be done or are there potential troubles ahead in which case unfortunately they wouldn't be able to see him off.i cant think of any legallity and cant find any information on the subject matter

I'm no expert, but without a UK passport or a visa in their Thai passports, I don't think they will be going anywhere :(

 

You could possibly try getting emergency travel documents from the British Embassy, but they are really intended for passport holders who have lost their documents.

 

Hopefully someone will have better news for you.

That is spot on.

 

In fairness the OP has had 5/8 years to arrange a British passport for the children. First British passport applications are long-winded and will take the best part of a month to sort out.

 

No way can the children travel without a visa - the British embassy (via VFS) can turn round compassionate applications very quickly (24 hours in one case that I am aware of). The OP is likely to need the assistance of a visa agent.

It's certainly a pity that the OP didn't apply earlier for British Passports, but what's done is done.

 

Emergency passports are issued for travel to the final destination, not a round trip, and they're not normally issued as a first passport, you're advised to contact your embassy if you want to try this route, Emergency-travel-document/eligibility. The emergency passport would cause complications as it would be retained by the Border Force Officer at the UK Border, you would then have to try and obtain a UK Passport during your stay, or chance leaving on a Thai Passport that has no entry stamps.

 

The other googly I'm going to throw in that as the children are in essence British Nationals and as such don't require a visa to enter the UK, they shouldn't be issued with a UK Visa, see Tony M's post on this UK visa for child entitled to UK Citizenship. In essence that means that your children cannot legally be issued with a UK Visa, that doesn't mean they wouldn't though, but if the ECO spots they're UK Nationals they shouldn't grant the visa.

 

You might be better to contact the Consular Team in respect of an emergency passport and put yourself in their hands, I doubt if you'd get to speak to anybody from the UKVI, or you could take a chance and apply for visas.

Purely for the purpose of discussion............................ would it be reasonable to suggest that the kids HAVE entitlement to British citizenship, but that is not conferred until (for example) a British passport evidences the fact.

 

 

That said, I doubt the kids have Thai passports either.

No, the children are already British Citizens, not having a British Passport doesn't alter that, I suspect there are millions of British Citizens living in the UK who don't possess a passport, it doesn't make them any less British Citizens.
You are correct in saying that a British Passport evidences the fact you're a British Citizen and as such have the automatic right of entry without restriction.
