I have a question someone on here may know better than any lawyer hewre in the UK.

I was previously married in the UK to a Thai - she is both a Thai and UK National holding Thai and UK passports. We have 2 children who live with me. When one of my children was younger we got him a Thai passport - he was born in the UK and holds a UK passport too. His Thai passport is now out of date. My question is in the future could he just apply for another one from the Thai Embassy and then what about him claiming residency or geting his own family book or whatever it is etc.

My motivation is I am of the mind to use his status for him to own property in Thailand in the future. He is still under 10 years old right now so not in a rush but I would like to know if he has the option still. PS - I dont want to have his mother involved if at all possible. He does not speak Thai either.

I am sure more and more peope will be in a position like this and their children would like to know what their options or choices are in the future so any insight is most welcome.

Yes he do have the right to own property in Thailand as his mother is a Thai citizen at anytime ( the Thai law now said ) It will be better if you can bring him back to Thailand to apply for his Thailand IDENTITY card and at the same time get a new Thai passport just in case for the future, as no one can ensure what can be happen ( the law maybe change ) Also don't  forget to send him to school to lean Thai if not he will have difficulty to stay in Thai when he come back.

She will have to give approval for your child to get a passport or to do many other things until he reaches that age of 20. The only way to get around that is if you are granted full custody of your child.

He may not be able to get a new passport at a embassy or consulate until he is registered in a house book here and gets a Thai ID number.

 

Apart from the points made by @ubonjoe, also be aware of the existence of conscription for Thai males once they reach the age of 20. That is the downside of registering him in a house book. As @ubonjoe wrote, you may not be able to get a new passport without, however: a bit of a Catch 22 situation.

He must be in a blue housebook to get his first passport getting a signed copy of it might be his big problem
