Supreme Court upheld 15 years jail term for Yuyee

 

 

 

BANGKOK: -- The Supreme Court on Wednesday upheld the verdict of an earlier court hearing, sentencing a popular model to 15 years and three months in jail for smuggling cocaine into the country in 2012.

 

The Court found Chatchaya Ramos or Yuyee guilty of having in her possession 251 milligrams of cocaine when she was searched at Don Muang Airport on November 10, 2012. The drug was concealed in her suitcase.

 

The Criminal Court initially gave her a  20-year jail sentence but later commuted it  to 15 years and three months after she gave useful information in the investigation. She was also fined Bt1.5 million.

 

Yuyee was denied bail from both Courts and has already been detained for three years.

251 milligrams are only 0.251 grams ... which is as much as almost nothing ...

Former model Yuyee Intusmith now serves 15 years in prison for cocaine smuggling

 

 

BANGKOK: -- The Supreme Court today dropped the appeal of the former leading model Alissa "Yuyee" Intusmith in a drug smuggling case in 2012 which she was convicted to 15 years in prison by the Criminal Court.

 

The court’s decision thus ended her petition against the earlier ruling by the Criminal Court (first court) in June 2014 which sentenced her to 20 years in prison and to pay a 2 million baht fine for the smuggling of 251 milligrammes of cocaine on board a flight from Vietnam to Suvarnabhumi airport in November 2012.

 

However the first court commuted the prison sentence to 15 years, and fine reduced to 1.5 million baht after finding her testimony useful for the court’s trial.

 

Yuyee or also known as Chatchaya Cuesta Ramos, 44, appealed the sentence by the Criminal Court (Court of First Instance) to the Appeals Court.

 

But in September 2015, the Appeals Court upheld the first court’s sentence.

 

She later appealed to the Supreme Court.

 

In today’s hearing of her appeal, the Supreme Court dropped her appeal and agreed with the ruling of the two courts to pass on the 15 years imprisonment.

 

Yuyee was escorted to hear the verdict from the Central Women Correctional Institute where she has alteady served two years and nine months after the first court’s ruling.

 

She had attempted to seek temporary release on bail but her attempt was rejected as the two courts feared that she might run away if bail was granted.

 

In addition to serving 15 years in prison, her prison term was extended by another three months for having protected animal in possession as earlier ruled by Minburi Provincial Court.

Horrendous abuse of power here. She has been well and truly shafted by the courts (all of them).

I remember in the last few months a woman convicted of premeditated murder and sentenced to death was given bail. Appalling that no standards are set and followed.

 

The only thing that seems clear here is that she has pissed off some vip massively and this is her punishment.

In this country be careful where and how you walk because if you trip on the wrong foot your life becomes less worth than s..t.

251 mg...half a panadol. Should have stuck it in her ear instead of suitcase. I'd hardly call this smuggling, as such a small amount could only be for personal use. 15 yrs is way over the top for this amount. 2 years tops. 

Something very rotten about this case, though in Thailand that does not seem unusual, sadly.

The crazy thing is that simple possession of such a small amount would normally be subject to a small fine.

The report of the importing and arrest, apparently came some time BEFORE the plane landed, so the official version is dubious, to say the least, as is the weight going from 5mg to 251mg with no explanation.

I am saddened at this verdict. The Supreme Court normally manages better, and it makes me even more concerned for the B2 case.

Possibly an "influential person" who was the real king pin for whom she was just the instrument.  There is corruption and absolute corruption. She was absolutely set up no doubt.

Fifteen years for a quarter of a gram, are they serious !! while would-be murderers roam the streets with no fear of repercussions. Probably the saddest thing about this country is the complete lack of realistic justice. I wonder if the guys who hacked the crippled bread delivery man have had their wrists slapped yet ?

I got a 1 gram pill from my dr recently that was the size of about 2 large aspirins.

 

And her 251 mg's is 1/4th of that, if the OP article is correct. Crazy!

and 4 years would also been far to severe for 251 mg.......

I remember this case from last year. Her Spanish husband claimed she was framed because she allegedly stepped on the toes of local illegal wild life traders after she had rescued a leopard cup from a house. The amount of cocaine allegedly found "concealed" in her travel bag when she landed at Swampy mysteriously increased from initially 5 mg (i.e. some cocaine dust clinging to the bag lining) to 251 milligrams (a quarter of a gram!) in a later police report.

 

No local journalist has ever dared to investigate the husband's story. But then again, I fully understand why this has never happened. Whoever would've taken up that story would now either sit in jail too - or worse, would've died in a "mysterious accident".

 

Whatever the truth may be, it is by any standard a disgustingly harsh sentence shelled out by a justice system which otherwise routinely grants bail to accused murderers and perhaps may eventually slap them with a ridiculous low prison sentence - if they haven't fled the country unhindered or ordained in a monastery in the meantime, that is.

Very good article and the way her case has been handled seems like a 100% replica of the Koh Tao case..

 

Potentially planted evidence, they know before the plane lands, amount changing from 5mg to 251mg in court, threat to the family, big VIP asking for his cash back = scary...

Plus the drug she supposedly had, was not produced in court, it would be interesting to know who she had upset and how or why!  

251mg = 0.251g

0.251g = 15 year + 1.5mil

And 2 lawyers resigned.....one was scared and the case was too complicated for the other.

Wasn't she a singer as well... SAD...

Shame - their daughter is very young, very funny and doesn't deserve to be put through this. 

 

More like a punishment to the dad and daughter really....

 

 

Simple lesson.

 

Don't try to be good in Thailand. Those with power will hate you.
