Thaksin's Children To Be Forced To Pay Income Tax At 37 Per Cent Rate

Arresting a former PMs daughter is not an easy thing to do, etiquette wise, but it seems they've run out of options. Thaksin's daughter in jail? That's huge. Public reaction is unpredictable and AEC needs to do some serious PR work ro face a backlash from Thaksin's supporters.

Her time in jail will be shorter than that of Nicole Richie (82 minutes). This case will be dropped soon after the election regardless of which parties make up the next coalition.

Agree with that. I have never even been totally convinced that the PPP aim is to win the election anyway but just be a big and noisy enough opposition to ensure a better deal for Mr.T in the horse trading that has probably already started.

The Little Emperor in exile and his entourage have boldly gone countless times way beyond the limits where deals could have been made.

Maybe but dont rule anything out in Thai politics. After all at some point the one thing all agree on is everyone has to get back to making money. At the moment that is difficult for all.

In Thailand, never say never when deals are concerned. Besides, as these cases take time to evolve, the AEC as you know it will materially change.

In another development, an ASC source said the panel would today file criminal charges against Mr Thaksin's eldest daughter, Pinthongta, for refusing to testify on the Shin Corp share transaction and on those who were behind the deal.

Hum... you mean "file criminal charges" like... ASC was supposed to do... 3 weeks ago (october 10) ?

:o

We talked about it, already.

There is no point to say "we will, we would" bla bla bla.

Again, we are waiting for "ASC has filled criminal charges".

And, anyway, even if they do it, it's only a piece of paper... And then would start the whole circus of the police, and the judiciary system...

... 2 months before the elections ? We can seriously doubt it.

Exactly very little of substance will happen before the next government is elcted and formed and unless they are relatively stable with a big solid coalition majority maybe even not then. And that will be after huge amounts of money will be offered to try and form a coalition. This game has only just started.

Right now it must be nigh on impossible to get a civil servant to do anything controversial when they are not sure who their new masters will be.

Sriracha is going to be happy : we are making progress !

"The Assets Scrutiny Committee (ASC) handed documents to file criminal charges against Pinthongta Shinawatra, daughter of ousted premier Thaksin, with police at Bang Sue station for her refusal to testify about the Shin Corp share case after being allowed to postpone the process three times." ! (Bangkok post)

Now... Police will talk.

If indeed an arrest warrant is issued, I promise to eat my hat. :o

She sure could use her Dad's magical voodoo elephant wand about now as she's catching it from another entity. November will be an interesting month for her...

Revenue Dept Warns Shinawatra Siblings to Pay up Taxes

The Revenue Department has issued a warning to the children of the deposed premier to pay more than 10 billion baht in outstanding taxes on the sale of Shin Corp shares by mid-November. If they do not do so, their assets are to be seized.

Revenue Department Director-General Sanit Rangnoi revealed the department has issued a notification to Panthongtae and Pinthongta Shinawatra, children of ousted Premier Thaksin Shinawatra, to pay the 11.2 billion baht in outstanding taxes on the Shin Corp share sale by mid-November.

If the two refuse to pay, the department will proceed with seizing their assets to pay the taxes.

Sanit says the department has more authority under the law than the Assets Examination Commission so they should be able to seize the vast amount of assets belonging to the two Shinawatra siblings, to pay for the taxes.

He adds the two have the right to appeal the tax payment, but that the collection of the tax will have to go ahead, separate from the appeals process.

This latest edict looks interesting - though as with all other edicts passed down in the past year that start out looking like sharks, it will likely manifest as a toothless guppy. [sorry if this gets posted twice, but my internet connection is funky]

AEC Files Complaints against Thaksin’s Daughter

The Assets Examination Committee (AEC) yesterday filed a police complaint against Pinthongta Shinawatra, daughter of deposed Prime Minister Thaksin Shinawatra for refusing to provide the committee with testimony over the Shin Corp. share sale, which involves tax evasion attempts of Thaksin and his family.

AEC representatives, Monthien Charaenpol and Pattarawit Obsuwan yesterday filed the complaint with the superintendent of the Bang Sue police station, Lt-Colonel Sayan Petyuenyong.

According to Monthien, Pinthongta had postponed the testimonial session three times along with refusing to give testimony on October 9 when she decided to appear before the committee.

Monthien claimed that Pinthongta’s action had violated Article 25 of the National Counter Corruption law, which punishes violators up to six months of imprisonment and a fine of 10,000 baht.

In response to the complaint, Police Lt-Colonel Sayan iterated that the police station would summon Pinthongta for a hearing of her charges, adding that if she refuses to show up again, an arrest warrant will be issued in her name.

Meanwhile, the legal adviser to the Shinawatra family, Noppadol Pattama argued that Pinthongta was entitled to her constitutional right for not giving her testimony, which she claimed that any given words might affect her parents’ reputation.

Will she refuse the police?

Her father is an ex-policeman and ex-PM whose proxy party may end up running the counttry early next year. Personally I see a high chance of nothing much at all happening although admittedly the committeesds and police have to go through the motions.

Are they pointing at her get out of jail free card? There seems to be an interesting link between that and another thread that involves 17 million Baht and someone else from the UK.

I sincerely doubt that there are many members of this forum who are 'jealous' of Thaksin Shinawatra.

Um .. he's rich as hel_l, popular, powerful and owns a major sports franchise.

I've got to admit just a touch of the green-eyed-monster's influence. :o

Well let me see here, so far everyone who is associated with Thaksin is taking a hit, Including his wife and children. So far more or less Thaksin is clean but I admit to not have been reading the new topics the last few days. But what I am pointing out is how low he has gone to protect himself.

I agree...

If Thaksin was as wonderful as his supporters claim he is -- he would have already stepped forward to sort out these messes and pay his dues...

If that every happens, I will be delighted to cheer him for being a great guy...

...but I am not holding my breath...

If I were a betting man, I'd be trying to make some money on a bet that she will never spend a single night behind bars. I'm also pretty sure that she will never pay a penny in taxes!

As for whether she stays a night in jail, I have already made my bet. Less time than Nicole Richie (82 minutes). As for paying taxes, that will depend on what deal is ulitmately made, whether the deal is made with the junta or with the next government.

After months and months of threats and feints to bring the Thaksinocrats to justice - all seems to have quieted down of late.

Granted, the current set of 'leaders' are becoming more like toothless tigers with each passing day - but isn't there anyone in power with the cojones to keep the ball rolling - toward justice?

Here are some possible reasons why the judicial process has stalled:

1. The major players have made back-alley deals.

2. Thaksinocrats are too slippery to tether in.

3. The current leaders are pooped out and have run out of ideas.

4. They're all waiting for Decenber's election results to see who'll be in the hot seat.

Methinks it's #4.

As a comparison: the police chief in NYC just got busted for graft. That's the difference between a developed country with a real democracy (as flawed as it is in the USA, it's the best game going) - and a tin pot dictatorship like Thailand. Thai leaders can huff and puff and espouse all sorts of truisms about democracy and the need to end corruption - but if you look at how things really manifest, you see it's just so much hot air and posturing.

Taxman to seize Thaksin children's assets

The Revenue Department is preparing to inform the Bank of Thailand, related commercial banks and the Land Department through an open-letter of its plans to seize assets belonging to Panthongtae and Pinthongta Shinawatra, the children of ousted PM Thaksin Shinawatra. Sanit Rangnoi, Director-General of the Revenue Department, said full co-operation will be needed to ensure that their accounts and land assets are clear of legal bindings before they are seized. “Authorities have already begun the process of investigating their assets. Both had been given until today to cough up tax money from the sale of Shin Corp shares last year," said Mr Sanit. They had used assets that were ordered frozen by the Assets Scrutiny Committee as collateral to file a tax appeal.

Thailand targets Thaksin children's assets

BANGKOK - Thailand's Revenue Department is making inquiries of varied agencies for updates regarding the wealth of former prime minister Thaksin Shinawatra's son and daughter, Panthongtae and Pinthongta, respectively, in order to levy an estimated 12 Billion Baht in sales taxes, plus fining them or possibly seizing the assets, according to Department Chief Sanit Rangnoy.

The department has asked the Bank of Thailand, the Stock Exchange of Thailand, the Land Department, banks and financial firms to provide facts and figures pertaining to the possession of stocks, real estate, bank accounts and other property which had not as yet been foreclosed by the Assets Examination Committee.

The sum of taxes to be collected from Panthongtae and Pinthongta would essentially correspond to the totals of their unfrozen assets, according to the revenue chief.

Their wealth could soon be frozen or confiscated on the orders of the Revenue Department, should the deposed prime minister's children fail to provide bond against the taxation within 30 days after the department's final notice has been lodged.

In order to appeal for tax shelter, Panthongtae and Pinthongta are legally required to present a bond out of their unforeclosed wealth, while those assets earlier frozen at the order of the AEC will not be accepted, he said.

The estimated 12 Billion Baht tax mainly incurred from the sales of Shin Corp shares from the Shinawatra family to Singapore's Temasek Holdings last year.

Thailand to seize assets of ousted leader's children over unpaid taxes from Shin Corp sale

BANGKOK, Thailand - Thailand will seize assets of deposed Prime Minister Thaksin Shinawatra's adult children who failed to pay US$38 million in taxes from last year's sale of telecommunications conglomerate Shin Corp., the tax department's chief said Thursday.

The Assets Examination Committee, a corruption investigation team set up after Thaksin was deposed in a coup last September, had ordered tax authorities in April to collect the unpaid taxes from the former leader's daughter Pintongta and son Phantongtae. Both have refused.

"Today is the deadline," Revenue Department Chief Sanit Rangnoi said Thursday.

He said the last notice to pay the taxes and a fine of US$38 million was given to Thaksin's children 30 days ago.

The department is checking their bank accounts and land deeds in preparation to confiscate their assets, Sanit said.

The tax-free sale of the Thaksin family-controlled Shin Corp. to Singapore's Temasek Holdings in January 2006 triggered outrage among the Thai public, with many accusing Thaksin of corruption and abuse of power. The protests that followed caused political turbulence and culminated in the military coup that ousted Thaksin.

Thaksin's family sold its shares in Shin Corp to Singapore's state-linked Temasek Holdings for US$2.3 billion. The shares had belonged to Ample Rich, a holding company owned by Phantongtae and Pintongta.

The Revenue Department ruled then that the deal was tax-free, but that ruling was reversed by the Assets Examination Committee in April.

The corruption investigation team and other government agencies are probing several allegedly corrupt deals undertaken by Thaksin, his family members and colleagues.

Thai courts have issued arrest warrants for him and his wife on land deal and asset concealment charges, and Thai prosecutors have been preparing to seek his extradition from England.

Revenue starts seizing assets of Thaksin kids

Siblings failed to pay tax, fines by deadline

The Revenue Department has begun the process of seizing the assets of the Shinawatra siblings after they failed to pay back taxes and fines totaling 12 billion baht by the imposed deadline. Sanit Rangnoi, the Department's Director-General, has asked the Bank of Thailand, commercial banks and the Land Department to list the assets of Panthongtae and Pinthongta Shinawatra and submit them to the department. Mr Sanit said the Department is looking for assets that have not been seized by the Assets Scrutiny Committee (ASC) or been put up as collateral or mortgaged. The Department is authorised to proceed with asset seizure without coordinating with the ASC, he said. The siblings were accused by the ASC of evading tax on the capital gains they made from the share transactions related to Shin Corp's takeover by Singapore's Temasek Holdings. A source in the Department said yesterday that authorities have located some assets of the siblings which can be confiscated to settle the back taxes and fines. However, the department is required by law to ask agencies concerned, which include the Central Bank and the Land Department, to be sure that the assets have not been put up as collateral or mortgaged.

and STILL they get referred to as "kids".... whereas Panthongtae is soon to be 29 in 2 weeks and Pinthongta is 26. Perhaps when they are in their mid-40's, the media will drop the "kids" moniker.
