Your child is Thai by birth if his birth certificate shows a Thai as his father. Nothing more is needed than that.
Have you gotten a passport for your child yet?
I'm the only one on the birth certificate as his paperwork was not together at the time of birth. He wanted to use his brothers ID (proper papers) for the birth certificate but I absolutely refused- I'm not about to have my baby's paperwork muddled with fraud, especially claiming the father is a man I'd never even met at the time. Insane. My son does have a passport now (american) and we've traveled internationally already- he has the same multi entry tourist visa that I do at the moment.
I'm happy to hear that I can piggyback off my edu, but does that mean I must have my edu issued BEFORE I can apply for his or could I potentially do the paperwork together? If not at the same time, could I do his paperwork immediately after? As in, could I bring him to Penang with me, receive my visa from the embassy and the next day file for his, then both re-enter the kingdom together?
I've heard of the law where young children dont get overstay fines, but with so many laws suddenly changing, it seems like a risk that could result in a blacklist and could affect our overall ability to exist at least part time in this country. Also, if he was on overstay as a tourist, wouldnt it then potentially come up as a problem to travel abroad, especially on short trips? I assume that the same general standards for allowing foreigners to enter the kingdom would apply to children in regards of already having existing stamps- especially if there are overstays involved. It sounds like too much of a risk to rely on him being allowed to overstay and assume we could enter with me having my edu and him having nothing, or assuming an embassy will just continue to issue him a tourist visa.
As for him having an edu for pre-k, I'll look into it, but I'm pretty sure he's too young to join any place around here- and I'd be skeptical of actually dropping him off at a place that would allow it. Frankly, the education options on the island I live on are infamously rubbish, which have driven a lot of expats living here to develop homeschooling study groups for their kids- but unfortunately I dont believe that option offers the possibility of an edu visa as they're not officially registered. I'll look farther into that, but pretty sure I'll strike out.
I hope piggybacking will work for now, and maybe by the time another option is needed, his father will be able to offer some help at that point. He's from a small village in which her majesty the princess came to help all the stateless and paperwork-less children, but of course, he was too busy being a careless punk teenager in bkk during that time as he was sure such things would be irreverent in his life so didn't jump on the bandwagon while he still could. Now he's been informed he's too old to apply for such things and any attempts to sort him out have been rejected- aside from corruption, which thus far has been a black hole of empty promises at a price. I can't rely on all that working out, so unfortunately I have to operate under the idea that he may always be just as much of a foreigner here as I am- even though when you look at him he could pass for even a pure blood Thai.
ther is no fine and will be no fine for kids under 15 years, and if somebody write something else here its bullshit,
kids under 15 years are not responsible under law, so they cant be fined. same you cant be fined for your mothers overstay or husband or what ever. you can save all the money and time for visas, he will need when he will be 15 years, never before.

A process where bona fide and qualified freelance workers who do intend to work IN Thailand can make applications for full legalization with visa and work permit. On a case by case basis. Judged value to Thailand or not. Perhaps because such applications would be more complicated and subjective, all routed through a specialist in Bangkok.
Change the rules for those on retirement extensions.
ALLOW volunteer work without work permit. Many retirees have the time, have the skills, and want to help out and many Thais could use the help.
yes thais could use the help, but thais dont want any help, because the think they are the smartest and most important people on earth

We seem to be accepting that any overstay is accidental or unavoidable.
Is it really hard to respect some of the most simple of laws here?
so when they will change the rules to:
when you get caught driving motorbike without helmet then you will get deported and banned for 1 year,
you just say respect the rules,
or when you buy a condo and you get ripped off by the thai seller,
police say to you: sorry but this is thailand respect the rules

Why do people think the new rules are harsh and "tuff"? That the law, and people ought to abide by it. To illustrate the point, some years back I overstayed my visa in an African country by two weeks. On my way out, I was arrested at the airport by the Immigration police. After an hour long "court case" (at the airport), I was deported and banned from that country for 10 years! How's that for comparison?
so how you would feel if you would have a kid there or gf or wife?

None of this is retroactive is it? I mean I did have a 3 year overstay a couple of years ago.....I am going to Laos tonite for a non O based on being a father......
Can I ask ? Are you over 50? I looked (a little) into this and saw a sticky on this subject saying you must be over 50 to use this exception (or whatever the technical term would be)

They was FKED the day they decided to overstay.!!!! I don't want to be evil to people, but right now many a crying about the new rules there is in forced. Accept this is there's country and there's rules and laws, you are allowed to stay here as a guest. People had plenty of time to sort this out. Like another member said. I'm a customer. Or Some other said I used 100000 of baht every month here or millions every year, I'm a good customer. Yes you are a good customer, but you have to accept you are a guest and you have to followed the laws. You can not demand
Yes there are rules and law, and the law is for overstay is the maximum fine 20000 baht, and the was no other risk, so why you damm people for doing overstay?

there are many reasons to be on an overstay, even can be a clear decision,
I was thinking about, I had a NON O Multientry and had to make visarund every 3 month,
took a day, budriving made me sick, costs about 1500 Baht, so if you calculate all together,
then why not use this optiion pay 20000 Baht and come back. This was the rule until now, and if somebody made it,
then he made the cecision, but this not make people a criminal!
breaking law in Thailand is very easy and get fined much easier, even you do nothing wroong

Does seem a bit harsh on those that get apprehended on the way to the airport with say 10 days of overstay and wont be allowed into Thailand for 5 years.
I suspect common sense would prevail... One would hope..... In that, if the overstayer was in possession of luggage and an in-date flight ticket out, then they would be allowed to proceed to airport immigration.

This gives a whole new dimension to your story. You did not overstay due to your lost passport and by no stretch of imagination will any authority accept this. You overstayed for a year and were apprehended after the girlfriend ratted you out to police. Is that what you are saying? If you reported immediately after your passport was stolen and applied for a new or temporary travel documents from your embassy, this would not have happened.I overstayed 1 year after my passport was stolen then girlfriend turn me in to police then I went to court and paid my fine 750 ThB and judge told me to just get new passport and new visa and I was fine to stay.. immigration police were supposed to take me to my Embassy but instead took me to IDC and I met my embassy people there and arranged new passport and ticket home from there

Which cost, which changes? It's just an eTicket printout (some worthless piece of paper)
that they 'pre-announced" to be asking. And many not even bother to check.
Except that if this rule is applied,
it means that everyone leaving Thailand while on a 30-days extension must exit from Thailand by plane!
A direct consequence could be: people on this extension are refused to exit at a land border...
you can leave the country at any border what is open, you cant refuse people to leave thailand

Go say that to the owners of the many clubs and discos currently closed in Pattaya. An extremely rich owner of the Lucifer Disco is said to have proposed to pay " a fortune" to reopen his club closed for 60 days... but the club remained closed!

Even with this seemingly good news it baffles me to read posts that call people who utilized the in place - functioning Thai immigration system of the very recent past - and for nearly 10 years prior - ABUSERS. A system that allowed most anyone (tourists) to perform border runs and visa runs to obtain more 'staying' time in Thailand... No one was abusing anything ... Border runs to get extensions of 15-30 days were ALLOWED... and not just allowed - they were facilitated by Thai Border Immigration officers.
Even if one was 'working' in Thailand - the act of working in Thailand without the proper visa was/is a violation of Thai Law ... BUT the act of making border runs to get extra staying time in Thailand was not a violation of law nor an abuse - no trickery - no subterfuge was utilized - no false papers were presented, (fake passports - fake visa stamps, etc.). None of this was necessary - because crossing the border with the minimum of credentials was allowed and facilitated by agents of the Thai Government.
Abusing a system - which rarely questioned an extension of a exemption or tourist visa was an ABUSE ? Laughable.
The Thai Government created by default the system that was in place for many years - so they are now enforcing laws that they did not want to enforce in years before ... but some people abused a system that was not abusedable - IT WAS ALLOWED!

If the airline is going to require you to have a return, or at least onward, ticket within the 30d window, then what good is a 30d extension option? Someone's heart was in the right place I guess, but yet more uncertainty and confusion.
there is no requirement, there is only a requirement for a return of forward ticket

If you're only going for 3 weeks you'll get a 30 day visa exemption just like all the other tourists from the UK do.So what should I do? I'm only going for 3 weeks. I have flight ticket back to UK

As in the case of the 28/28 rotation oil workers etc who have been mentioned several times.. if the immigration officer is counting previous stamps in the passport, then quite a lot is going to rest on whether the immigration officer feels it is credible that a person can be a genuine tourist in Thailand several times a year simply because they have the money to do so. Further complicated if the tourist keeps a rented condo because it is more convenient and cheaper than paying for a hotel every day.
It may be logical to us that such perpetual tourists do exist, but may not be in the eyes of the immigration officer....
How they want to handle the people who own a Condo in thailand, or may be more Condos? they cant refuse them enter Thailand,
All this people have the right to check their propertys or to live in their Condo,
They may be have to leave every 30/60 days but they have the right to enter Thailand again.
Or Thailand will break international contracts and agreements and the country will have to pay compensation!
Thy can not change the rules for Investors, and if they only try then it will be a huge impact of the building bussines in Thailand, ghosttowns in Phuket and attaya

whats the point of a tourist visa if after 29 Aug you can get 30 days on arrival and then extend for 30 days ..?
You don't have to go to an Immigration Office.
what I also am getting at it makes whats going on now quite over the top, as all that have been refused entry over the past 2 weeks will in effect on 29 Aug be allowed into thailand for a possible 60 days...so i just think they has messed up big time ..toughened up the immigation requirements when most of the border have forgotten them. it is very clear on the 10 year over stay that some one has reminded thailand of human rights issues..if they have children of married to a thai national..then ban them for life?
you even can not ban them for 1 year, you can fine them if they work illegal, prison time or fine, but if somebody want to visit wife or children you cant ban!

I may have misunderstood, but my question would be: will airlines allow somebody to board a flight for Thailand if their return ticket is more than 30 days ahead and they have no visa? in other words: will the airlines place any weight on the fact that a 30 day visa exemption extension is possible? If the position is unclear then tourists who fancy a stay of six weeks or so will probably still want a tourist visa.
I never got ask for a visa if flight back was after 30 days, i dont know about 1 way ticket but for EU citizen not have any problem with boarding even with a return ticket of 1 year

I will add that in my own opinion.
The VAST MAJORITY of people whom this affects (probably north of 90%) are in fact thieves, rapists, terrorists and murderers.
These people are a cancer on society, and once they choose their path that they travel, they should not be considered for human rights. They don't consider the rights of their victims, so why should they have extra consideration from society?
I agree that victims and relatives should not be forced to face these criminals, but I would say that those who do not wish to is again a very small minority, and I doubt they are forced to attend. I think you will find that they are not forced.
I really wish you to get accused wrong by thai police of a crime and then you try to show innocents and may be then you will be remember your post here,
everybody has the right to a fair trail and a decent treatment, this right is not for protect the guilty people but all the innocent ones!

Home schooling is going to be hurdle to jump as in truth you as a parent being an alien person in Thailand have no standing in society.
Indeed you are in or rather your son is in a very precarious position.

and so far I home-schooled my son until he was 8.5 years old.
and then he wanted to go to school... (so I sent him to an international school in bkk)
- that particular school goes up to year 6 (12 years old).
(so you could say that he has 'graduated' from that school).
nothing much really appeals to me or him (for High School) in Bangkok... (as we are very much an art-based, alternative family and anti-establishment to some degree)... so the thought of putting him into a high school will be a uninspiring un-educating nightmare.
hence, back to Home school again (until I can find a better alternative).
for the moment,, I am assuming the Ed Visa is the easiest way to bridge this gap of uncertainty.
as to whether he gets blacklisted for overstaying... i will let you guys know
but some other people in this forum are saying the Cut-Off age is 15 !!
which is completely different to what some immigration officers at the airport and also one border crossing told me.. (they said it was 12).

the age is for sure 15 years, I dont know why the people here spread rumors all the time, no fine for kids under 15 years, and when the OP is on ED Visa he can get his son on depended extension

Thailand should have a database of VIN numbers that stay with the car through multiple years and owners. This is a golden opportunity for the Thai military dictatorship to haul off these Thai government officials and publicly perp walk them, give them trials, and if convicted, loss of benefits and pensions, with fines amounting to money swindled.
thailand (Junta) do not have any interest in bring anybody to trial, only a big show, but no court cases

Pity this thread turned into a visa discussion, I was more interested in hearing about the state of affairs on KT...
Of particular concern is that nobody has jumped on the OP for claiming 90% of workers on the island are illegal. Combine that with rumors of dubious land ownership and illegal construction; things aren't sounding too good.
I'm not picking a fight with the guys living there - just saying a clearer picture of the situation would be nice.
For example, of the 64 businesses, how many are legal, and of those how many are foreign owned.
Are there any illegal Thai businesses?
What WP is available to get legal and what are the onerous requirements stopping so many?
Apologies for all the questions but there may be an opportunity here to help others make more intelligent decisions.
Sorry ParadiseLost but the thread did not turn into a visa discussion. It was always intended to be a visa discussion and what impact enforcing existing laws might have on the islands.

NB the visa rules are not new. They are just being enforced now.
I cannot speak for Koh Tao, I live on Samui.
I have lived on Samui since 2000 and I have been travelling to Thailand since 1993 (when I first lived and worked in Bangkok).
I have never had a problem obtaining a visa to visit the Kingdom, whether it be a business visa or a tourist visa. I have managed to get these visas in a number of different countries. You sometimes have to 'jump through a few hoops' but it was never a problem.
I have had a work permit since 2003 having started my business then.
The work permit was easy to obtain and it is just as easy to renew. What are the rules - dunno. I pay someone who has a real knowledge of the requirements to handle it all for me. That person organises my work permit, visa, company documents, land titles, taxes and any information that I have to provide to the various government bodies.
So - I do not really know why, for some people, getting a visa and/or getting a work permit is so difficult.
I can ony assume that it is down to either laziness, cannot be arsed to do some homework before I travel, lack of money or just tight fisted. Maybe because it was so easy to do things illegally, people just never bothered to get it right. I really do not understand it.
As an aside - article in the Samui Times states that Thai Embassys and Consulates overseas are still issuing tourist visas. It seems that it is just the border bounce people that are having problems. Visa on arrival at an airport - no problem unless you have a passport full of them.

Regarding the legal v illegal Dive Masters and other businesses on Koh Tao - some have manged to do it properly so it is doable.
When I last visited KT some years ago I was surprised to see foreigners serving in bars and restaurants. This is illegal. They are restricted jobs for foreigners. I rarely saw a Thai person. Lots of Burmese though. I suspect that Thais do not want to live there - especially for the salaries being offered.

to know somebody to know how to get a work permit doesnt it makes legal,
so you pay 4 thai staff 9000 Baht salary every month + social insurance, their tax and your company tax?
it makes you running costs of minimum 60000 Baht every month for your work permit, so may be this is not the solution for
people who teach diving.
and may be you not have this cost then your work permit is produced by a fraud and illegal too
1. I hate if all the smart people here say respect the thai law, it is illegal to work, get your proper visa, and so on
2. most of this guys breaking the law also, building companys to buy land or houses, use thai shareholders without they have payed any shares,
use thais to run bussines, making false statement that their wife owned the money for buying a house and so on

99% of all limited company with foreign shares a breaking the law, because the thai shareholders never paid any money, they are only muppets and paid nominies, it is the only way for foreigner to open a bussiness, pay 100% and own 49%.
without foreign bussiness thailand would have 70% less tourists,

i think the fact you had your daughter's birth certificate swung it: It shows you have good reason for being long term in the country. Once you get the correct visa, you should be fine.
if you have a thai child or a wife in Thailand they can not stop you from entering the country, it is against thai law,
you can go out and come back every day

There's no fine for children under seven years of age I believe. Also it's very unlikely that you will get stopped and jailed on the last couple of days of your holiday so just go ahead and do the extension and make the best of the time you have left.
omg, all the rumors here, dont write things what are not true, kids under 15 years dont get charged for overstay

This determination of guilt without trial is definitely not politically motivated.
The trial comes after the decision by the NACC to indict her.
That is the next stage.
If she is innocent of negligence, she should return after her shopping trip to clear her name.
She has the money to hire the best lawyers.
in Thailand you never can expect a fair trial, and everybody of you would leave the country and not come back for sure, dont blaim other people if this happens,

it is not the same to carry a ID plastic card or a 6 times bigger paper book, for this you even dont need to have a university degree!
a Thai driver license is a valid ID in thailand, you can travel, check in in hotels, fly aso,
even Immigration give you the passport back after 24 hours when you apply for extension in some places, so this would make them breaking the law. you could apply for any Visa in any Embassy anymore, you even couldn´t apply by post for residence certifficate in embassy,
I dont think in Thai law is written that a person has to carry a passport, I guess there is written every person has to have a valied ID and a thai driver license is a valid ID, with adress, passportnumber, name, date of birth, place of birth.
I would never pay any fine when i have my Thai driver license with me, what they want to do? worse thing is come with you to the place where your passport is stored. Arrest you? if you didn´t break any law, no arrest warrant, nothing to solve, to keep somebody in policestation, there must be a good reason, and if you provide a thai driver license they have enough possibilitys to check you.
