Clear evidence gathered recently of which the FBI is looking at these statues: 18 U.S.C. SS 793: Gathering, transmitting or losing defense information, which carries a penalty of up to 10 years in prison. 18 U.S.C. SS 2071: Concealment, removal, or mutilation generally, which carries a penalty of up to three years in prison and disqualification from holding office (more on this below). 18 U.S.C. SS 1519: Destruction, alteration, or falsification of records in Federal investigations and bankruptcy, which carries a penalty of up to 20 years in prison. The FBI is not going to reveal an affidavit and compromise its position when this is potentially a very serious case.

  23. Looks like they were taken but also either returned or ready for return according to this. It was also the DOJ that alerted Trump to this beforehand but he then decided to make his accusations on the "Truth Social" platform that they were stolen. 1) DOJ obtained three passports (two expired, not one, as Trump said) and alerted Trump lawyers 2) They were recovered by a filter team, which weeds out privileged info. 3) Trump publicized this after DOJ offered them back https://twitter.com/kyledcheney/status/1559324841681063936
