  1. If Justice Thomas were a Federal Appellate Court judge there would multiple means to have him removed from conflicting cases or just plain removed. But for a sitting US Supreme Court Justice, there is not.

  17. So I will go out on the proverbial limb here: Sentencing by Judge Merchan is scheduled for July 11. Trump team must wait until then to file a notice of appeal within 30 days. Then they would have 6 months to file their initial brief with the first level (of 2) NY State appeals courts. 6 months from then will be after the election. My guess (and I have not read this elsewhere) will be that they will file a brief well before the election and make sure that their narrative and basis for appeal is widely circulated and maybe even nudge (irritate?) team Bragg why do they not respond well before the NOV 5 election.
  18. At least according to Elie Honig on CNN, the reason Todd Blanche was allowed in the pre-sentencing ZOOM is that Trump has 3 other criminal trials in process and anything said at the NY State felony pre-sentencing might be allowed as evidence in those other 3 trials.
  19. The Mikado sang "To let the punishment fit the crime" In this case, it may be on appeal, did the charges fit the crime as prosecuted. And much of the eventual appeal will deal with Judge Merchan's rulings before the the actual trial even started.

The damage the guy could do in the US and world even on a daily basis is more than I care to contemplate. CH Trump is damaging democracy right now. He’s continually attacking Democracy and the institutions of Democracy. He’s already convinced millions of Americans that Justice is corrupt, he’s holding the torch for despots and tyrants the world over. On the upside he’s destroying the GOP. JM Great. so think what more he could do as President. CH He’s not going to be President. He’s headed to prison.
  21. Trump has no prior criminal record, and while that's often the case with white-collar defendants, the lack of a rap sheet could help Trump avoid jail time. Even if Trump doesn’t avoid a jail sentence, Trump’s seemingly endless stamina for legal appeals, coupled with New York’s bail laws, could keep him free while the appellate process plays out. Due to New York’s bail laws, it is almost certain that Donald Trump will remain free on bail pending appeal while all of his various appeals go through various courts. The idea that if Merchan sends him to jail, he’s going to spend the Republican National Convention behind bars is not plausible.
