That “this is not looking good” was in reference to Danderman123’s comment about the Trump team not putting on a defense for Trump as I was already familiar with the prior rulings of Judge Merchan that Ms. Rebecca Roiphe was referencing in her April 30 2024 NYT article. -
I put up his quote verbatim -- if you want to attack it that's up to you. But I don't have to justify it to your liking. And the Mukasey quote was AUG 18, 2023: Michael B. Mukasey, a former U.S. attorney general and longtime Manhattan federal judge, said because of the complex issues raised in all four of Mr. Trump’s cases, “I think the odds are slim to none that any of them gets to trial before the election.”

Just an update to Carroll v Trump sexual assault verdict appeal, the appeals court has denied a motion by Carroll for expedited decision: Plaintiff (Carroll) has not established good cause to expedite oral argument in this appeal. This appeal does not fall within a category of cases subject to automatic placement on the expedited appeals calendar. Any future attempt to postpone the argument once scheduled would require a showing of “extraordinary circumstances.” Accordingly, Plaintiff’s (Carroll) motion is DENIED, and argument in this appeal shall be scheduled in the ordinary course. 24 MAY 2024

But when I read the here linked article originally in NY Times that mentions indirectly some of the Judge's rulings pre-trial against the defense, I thought this is not looking good: I was an attorney at the D.A.’s office. No. There are 2 William Barrs. BTW I remember your saying the same for Judge Mukasey who said he did not expect any of Trump's 4 criminal trials would take p;lace before the election. Whatever his opinion, my concern with all this is that declaring Trump as a felon -- deservedly or not -- will help him win the election come NOV 2024. And I would prefer him not be for the next 4 years.

Or as Georgia Judge McBurney said of Ms. Willis in another ruling this case: Fani Willis -- what were you thinking? -

Well I don't see that you are the one it needs to be fine with. Judge Merchan's argument pre-trial as to what is OK, is. And there are enough left leaning legal scholars that say there are problems there as well -

Though the crime of falsifying business records is nominally a misdemeanor, the Manhattan district attorney’s office almost always charges it as a felony. Still, the Trump case stands apart. The (NY)Times could identify only two other felony cases in Manhattan over the past decade in which defendants were indicted on charges of falsifying business records but no other crime. -

A jury's deliberations is only a function of the evidence allowed in Court and the pretrial rulings as to how the charges can be presented, and then instructions to the jury as presented by the judge. Or in a nutshell might be presented by the defense in an appeal: Garbage in -- Garbage out. -
You can liken it all you want. The Feds got Capone on a tax charge because Chicago was too corrupt to ever go after Capone for murder, etc, With the Trump case NY state 175.05 false records on its own is a misdemeanor and the state 17-152. Conspiracy to promote or prevent election. on its own is a misdemeanor. Put them together with some "unlawful means" and now you have E felony.
