  2. Sure but AN fair use policy is 3 sentences
  3. It was a sharp about-face for Biden’s team, which had largely ignored the trial since it began six weeks ago and is now looking to capitalize on its drama-filled closing moments, sending the “Goodfellas” actor and the first responders who were at the Capitol on Jan. 6. Biden’s campaign had been wary about feeding into Trump’s argument that his criminal trials were the result of politically motivated prosecutions, but ultimately it decided to engage because its message about the stakes of the election was struggling to break through the intense focus on the trial. “We’re not here today because of what’s going on over there,” Biden campaign communication director Michael Tyler told reporters, gesturing toward the courthouse. “We’re here today because you all are here.” https://apnews.com/article/trump-de-niro-biden-insurrection-hush-money-78a33c5083a243e18f9fbd63ce9e8ddd
  4. Even if convicted, Rikers is no certainty. Merchan, however, would not be required to issue any prison time. He would have wide discretion to choose a lighter punishment, such as probation or a term of “conditional discharge.” A probation sentence would require Trump to check in regularly with a probation officer and abide by other rules. Conditional discharge would allow Trump to remain free without probation supervision, as long as he stayed out of trouble https://www.politico.com/news/2024/05/28/trump-merchan-sentencing-prison-00151613
  5. “He doesn’t belong in my city,” De Niro, a native New Yorker, said of Trump during a press conference hosted by President Joe Biden’s reelection campaign outside Manhattan Supreme Court. “We New Yorkers used to tolerate him when he was just another grubby real estate hustler masquerading as a big shot. A two-bit playboy lying his way into the tabloids, pretending to be a spokesman — a spokesperson for himself,” De Niro said. The “Taxi Driver” and “The Godfather Part II” movie star described Trump as a threat to the United States, and said that Trump fomented violence and destruction during the deadly riot at the U.S. Capitol Jan. 6, 2021, by a mob of his supporters. https://www.cnbc.com/2024/05/28/robert-de-niro-slams-trump-outside-criminal-trial.html DeNiro speaks as a native New Yorker -- for myself as living in NYC mid-1970's when Donald Trump became "The Donald" not much to argue with there.
  6. NYTimes headline 21 April 2024: Will a Mountain of Evidence Be Enough to Convict Trump? Monday will see opening statements in the People of the State of New York v. Donald J. Trump. The state’s case seems strong, but a conviction is far from assured.
  7. Whether Hope Hicks or any other witness, none of them explained why it was that their testimony broke any law or a succession of laws (i.e. 'another crime' that itself was constituted by 'unlawful means') that would be responsible for a guilty verdict. Judge Merchan's jury instructions tomorrow, will have to unravel, what a very liberal think tank analysis in support of the Prosecution's case asked: Clear as mud?
  8. All the Prosecution witnesses described what happened (at least I believe) save maybe Cohen, factually. As Ms. Haberman noted in the quote above, none of that explains why this is a simple legal case.
  9. They received subpoenas from the Prosecution to testify under penalty of perjury. (Hope) Hicks, appearing in Manhattan Supreme Court under subpoena, testified that she has not spoken to Trump since the summer or fall of 2022 https://www.cnbc.com/2024/05/03/trump-trial-resumes-after-infamous-cohen-phone-call-tape-is-played-for-jury-.html
  10. The closing argument from Steinglass, which lasted more than five hours, somewhat undermines the idea this is a simple case. It’s a simple story, but not a simple legal case. Maggie Haberman NY Times
  11. That's OK. Even though you and the NY Times reporters were in the same courtroom, you still can see it differently.
  12. Joshua Steinglass is now describing evidence from February 2018, and he is competing not only with the defense but with jurors' flagging attention spans as the clock moves toward 6:30. One juror just rubbed his eyes, another’s are heavily lidded. Four jurors in the back row are still paying close attention, but the signs of fatigue are definitely becoming more visible. Some are still looking at Steinglass, but several are fidgeting, tilting their heads and glancing around, signs that a jury is being pushed to its limit. Before they (jury) returned, the judge told the prosecutor that he needed to wrap up — at least for the day — by 8 p.m. https://www.nytimes.com/live/2024/05/28/nyregion/trump-trial-closing-arguments
  13. Sequestration is most commonly used in high-profile trials in which media coverage and public conversations about the case may be so ubiquitous that it is difficult for jurors to avoid. A judge also may order that a jury be sequestered to prevent others from tampering with them through undue persuasion, threats, or bribes. The trials of O.J. Simpson in 1995, George Zimmerman in 2013, Bill Cosby in 2017 were modern cases in which it was done, with the jury spending 265 days in sequestration in the Simpson case. In 2021, the jury in the Derek Chauvin murder trial was partially sequestered during the trial itself, and fully sequestered during deliberations. https://en.wikipedia.org/wiki/Jury_sequestration
  14. Trump lawyers didn’t forget to check a box on jury trial, Judge Engoron says Published Oct. 12, 2023 Donald Trump’s attorneys did not forget to check a box to request a jury trial in the Trump Organization fraud trial, New York Supreme Court Judge Arthur Engoron said this week in an effort to clear up misinformation about the high-profile case. “We are having a non-jury trial because we are hearing a non-jury case,” Engoron said, according to Yahoo! News and ABC News reports. “It would have not helped to make a motion. Nobody forgot to check off a box.” https://www.legaldive.com/news/trump-lawyers-didnt-forget-to-check-a-box-on-jury-trial-judge-engoron-say/696385/
  15. Under penalty of perjury. But your "Decided to Tell" makes it sound like it was voluntary. Reminds me of the lines from MASH (movie) Hotlips O'Houlihan: [to Father Mulcahy, referring to Hawkeye] I wonder how a degenerated person like that could have reached a position of responsibility in the Army Medical Corps! Father Mulcahy: [looks up from his Bible] He was drafted.
  16. I was only taking exception with your "decided to tell" characterization.
  17. They didn't just 'decide to tell': Over 30 Trump associates subpoenaed by grand jury over alleged efforts to influence 2020 election results Updated on: September 13, 2022 More than 30 people associated with former President Donald Trump and alleged efforts to influence the 2020 election results have received federal grand jury subpoenas, four sources told CBS News. Those who were served subpoenas included employees and contractors for the Trump campaign and Republican National Committee, including poll watchers, according to two sources familiar with the subpoenas. The sources said the identities of those subpoenaed range from household names to mostly unknown, low-level field staffers. FBI personnel served several of the subpoenas early in the morning last Wednesday and Thursday, the sources said, adding that in at least two instances, agents executed search warrants that allowed them to seize individuals' cell phones. https://www.cbsnews.com/news/30-trump-associates-grand-jury-subpoena-2020-election-results/
  18. Discharged. So somebody must've cleared their bill.
  19. I guess the answer is that I am not like you. Put Ubuntu on a computer a few years back and didn't like it. That's sumthin: You look just like Boo Radley.
  20. Brad Smith: What I would have told the Trump jury May 20, 2024 10:01 pm Smith said. “To use an example I’ve often used, it’s not a campaign expense if a businessperson is running for office and his businesses are getting sued, and if he goes to his company lawyers and says, ‘I want to settle these lawsuits against us. We’ve got some wage employment lawsuits and a woman is alleging sexual harassment. We’ve got 36,000 employees, but we’ve got these three complaints and the press will make a big deal about them. So I want you to settle these.’ And the company lawyers say, ‘No, these are great cases we should win. We shouldn’t settle them.’ He says, ‘I don’t care. I’m running for office. I don’t want press stories on it. I want you to settle them quietly.’ Well, he cannot use campaign funds to pay that settlement, even though he is clearly doing it for the purpose of influencing his campaign.” https://www.washingtonexaminer.com/daily-memo/3011093/brad-smith-what-i-would-have-told-trump-jury/

  22. No. Did you join the Prosecution team?
  23. NY Times headline today: Trump’s V.P. Pageant Has an Unexpectedly Strong Contender: Tom Cotton Donald Trump’s interest in the Arkansas senator reflects a desire to choose a running mate with experience and the ability to run a disciplined campaign.
  24. If someone from Staten Island wanted to get to Crotona Park in the Bronx, they would likely take the free Staten Island Ferry to Manhattan and from there get the #5 train to the E. 180 stop in the Bronx and from there about a 4 minute walk to Crotona Park.
  25. Noted earlier from a 16 May Judge's conference Counselor Bove said as to the 'irrespective condition' : ... which we think is an important issue for the jury to consider with respect to whether the payments at issue could be considered expenditures and /or contributions. As you say, closing arguments next week.
