  3. I know, and I aslo think there's a clear moral obligation. An additional special occasion wouldn't hurt, just in case. But according to the law, not necessary.
  4. I would only do it after professional advice, and preferably not this year - later, when the dust has settled. Gift tax was discussed in the first tax thread in extenso, opinions differ. I think Mike Lister has summarized it in the pinned tax guide. You are probably ok, but I would gift it as a special occasion, just in case: wedding or something like that (betrothal? Exams?). Birthday may not count.

I have read your articles with great interest (some are behind paywalls) and what they write has been said for years (e.g. 15 years ago, I myself thought Vietnam would overtake Thailand within 20 years; now I read "by 2038"). The reality on the ground I see every day is what @soalbundydescribes. How can this be reconciled? (I know people say "it's all debt". Really?)

  8. NO, it isn't! Thais see the reality of their country every day, and it's sad enough. Don't think they don't realise it. But it's one of the most basic rules of Thai culture: avoid telling the truth about reality. Too confrontational.

The TRD has said that using a foreign CC in Thailand is a taxable remittance. Not easy to find out (at the moment) Getting professional advice about the gift route sounds much better

  14. Short answer: yes Long answer: you are comingling 2 things. 1. Paying for goods and services in Thailand directly from your foreign account, eg by Swift. I don't think anybody has ever claimed this would not be a taxable remittance. I am not 100% sure, though, and I don't have the time to dig it up in the text guide now. 2. Using a foreign credit (not debit) card at an ATM in Thailand or to buy good in services in Thailand. TRD has said in one of the embassy videos (I think the French one) this is a taxable remittance. Some posters disagree eg @JimGant: credit is not income. Details with lots of arguments in the pinned tax guide.

  17. It's not the easy solution for everybody who is married: It should be a real gift - not a "gift" she just gives back to you. Read up on it in the pinned tax guide, you should be able to find it. It's not easy to change it because it protects the wealth of the rich Thai families.

  20. I will follow Charlie and pretend you have good intentions (but I don't think so). So I will explain one last time: You are comingling two questions. Question 1: 1.1 If Fred had followed the law in Thailand, he should have paid tax in Thailand on his pension in all those 10 years. Correct. 1.2 TRD didn't care. Correct. 1.3 TRD could strictly follow the letter of the law and ask Fred now "what about the tax you should have paid during the last 10 years?" Correct, but improbable - especially as TRD officials have stated publicly "in the past we didn't care" Question 2: Has anything changed for Fred? Yes, now they DO care. "1.2 TRD didn't care." is not valid anymore. Can you derive this from the letters of the regulations? No. Can you derive this from the context and intention of the regulations? Absolutely, especially as TRD officials and even the PM have publicly said so (links to their statements - YT, press statements, you name it - are all over these threads)
