  1. This obviously means that the Ministerial Regulation issued in 2002 (or was it 2003) under the authority of section 96 bis of the Land Code Act outlining the conditions for land ownership by foreigners remains in force unchanged. Does anybody have a link to that Ministerial Regulation?

  4. Section 86 of the Land Code Act suggests that some sort of reciprocal agreement already exists since 1954 with some countries. To the above, Section 96 bis was added in 1999, giving foreigners the right to by land also where no reciprocal agreement exists between Thailand and the country of which the foreigner is a national, subject to Ministerial Regulations and the Minster's approval for the acquisition.

Even government spokespersons have quoted in news articles to have allegedly referred to a new law, but what has reportedly been approved by the Council of State (cabinet) is in fact a new Ministerial Regulation, replacing the previous regulation. This regulation, and an number of other regulations, need be issued as required by the law, for example by section 96 bis as regards land acquisition by foreigners: My personal impression is that this new regulation and its previous versions are designed to discourage land acquisition by foreigners. It is what I like to call "the Thai way of not saying no". If a foreigner meets all the conditions laid out in the Ministerial Regulation the Minister of the Interior still has the legal authority to disapprove the application, making this an explicit "No" 24 years have passed since the addition of section 96 bis to the Land Code Act and it would be interesting to know how many applications for land purchase by foreigners have been made since then and how many have been approved by the Minister.

The news article "Lady Kai" back in the news! 2016 sensation accuses media and keyboard warriors of defamation makes me wonder whether the various romanised pronunciation systems one sees used in news stories and on this forum have official or otherwise somewhat recognised names. In "Phee Kai", used as a synonym for Lady Kai in the cited article, — "Phee" obviously means พี่, an honorific for an elder sibling or an elder friend, but from what pronunciation system is it? — "Kai" apparently stands for ไก่ (chicken) and I recognise it being part of the Royal Thai General System of Transcription (RTGS), but for all I know it is also part of some other systems.
  12. At last a news article which calls the new rules by the correct name, ie a Regulation of the Ministry of the Interior. Other articles called it a law or an edict or perhaps some other incorrect names. The law, ie The Land Act, and Ministeral Regulations as required by the law have existed for decades. The law also states that every individual application by a foreigner to purchase land must be approved by the Minister. This means that even when an application meets all requirements stipulated in the Ministerial Regulation, the Minister still has the authority to disapprove the application.

  21. Thank you, Jimbo551, for posting the above. It seems that not the law is being changed, but a new Ministerial Regulation under the authority of the Land Code is being issued.
