Election Commission warned over Senate rigging case

Thailand's Election Commissioners could face prison terms if they fail to take an alleged Senate election-rigging case to the Supreme Court, academics told a parliamentary seminar on Tuesday, August 4.

The claims concern alleged vote-buying and organised manipulation during the 2024 Senate selection process, involving 229 people, including Prime Minister and Bhumjaithai leader Anutin Charnviraku, cabinet members and 138 of Thailand's 200 senators.

Academics set out legal argument

The seminar was organised by chief opposition whip Parit Wacharasindhu. Thammasat University law lecturer Munin Pongsapan said the Election Commission is legally required to forward the allegations to the Supreme Court, given the evidence and witnesses already examined by an Election Commission subcommittee and the Department of Special Investigation.

Munin said commissioners have no authority to decide the merits of the electoral fraud allegations themselves. Instead, he argued, they must refer the cases to the court.

Four Election Commissioners were named by a majority of pro-Bhumjaithai senators, according to the report. Munin said commissioners who do not send vote-buying and election-rigging cases to the Supreme Court could face charges of neglecting their lawful duties and misconduct in office, carrying possible prison sentences.

Sukhothai Thammathirat University political scientist Thirapat Serirangsan made a similar warning, saying the commissioners of the "independent" agency must refer the historic cases to Supreme Court judges handling election cases.

Claims centre on Senate selection

The suspects are accused of involvement in planned and organised rigging, including the distribution of bloc-voting scripts and cash payments. They are also alleged to have arranged hotel accommodation and meeting venues for recruited candidates at district, provincial and national stages of the three-tier Senate selection.

Anutin has been specifically accused of meeting successful candidates at the Pullman Bangkok King Power hotel to select a Senate speaker and two deputy speakers. He has acknowledged visiting the hotel privately and "on a daily basis", but has firmly denied involvement in the alleged rigging alongside Bhumjaithai colleagues.

There has been speculation that the Election Commission may decide not to bring a Supreme Court case, while pursuing only "small fish" among the 229 suspects. That could expose the commissioners themselves to allegations of duty negligence and misconduct, the academics said.

iLaw project manager Yingcheep Atchanont named other suspected Bhumjaithai figures as Deputy Prime Ministers Songsak Thongsri and Pipat Ratchakitprakarn; Prime Minister's Office Ministers Paradorn Prisnanuntakul, Napinthorn Srisanpang and Suksamruay Wantaneeyakul; chief government whip Koravee Prisnanuntakul; and former deputy House speaker Supachai Bhosu.

Anutin, who is also interior minister, has previously threatened libel action against Yingcheep and People's-led opposition MPs over the allegations. Others were reported to be pursuing criminal cases in provincial courts.
