KANCHANABURI: -- A man wanted for murder at a Bang Pakong karaoke lounge in 2001 was finally apprehended yesterday.

 

He was at a relative's funeral at Wat Lam Thaharn in Ban Kao sub-district of Kanchanaburi when the cops pounced.

 

Kittichai, whose age was given as 33 in the Sanook story, denied everything though he remembered being at the karaoke lounge in question at 11.30 pm on the 19th of December 2001.

 

He told officers that there was a disagreement over who was going to sing next.

 

But he didn't do any shooting.

 

His mate "Noi" did it.

 

Kittichai said he was obliged to run for his life.

 

Thereafter he took a job stitching shoes in Bangkok.

 

He was taken in custody to Bang Pakong police.

so how does this work ? cops go to all his known haunts, friends, relatives fulltime ? doubt that or they would have had him much sooner; alternatively, do the cops then randomly visit those haunts, friends,relatives ? for 16 years ?

Surely the stutute of limitations has run out!! ??

Let's see... Probably 2 weeks in the temple and a 5000 baht fine... Good jokes go a long way to reducing punishment for murder!

Seems nothing is treated very seriously here apart from collecting money.  Whenever they catch anyone, often by chance or from a tip off and not 'detective' work, they are always seen to be 'having a joke' with them in a completely relaxed situation.    Not like the real world at all is it !

The bloke in the white shirt looks like he is about to say " If you don't stop laughing you slag I will have to give you a slap and your mate behind you can shut it too "

Causing Death

Section 288. Murder

 

Whoever, murdering the other person, shall be imprisoned by death or imprisoned as from fifteen years to twenty years.

Section 289. Death Penalty

 

Whoever commits murder on:

  1. An ascendant;
  2. An official in the exercise of his functions, or by reason of exercising or having exercised his functions;
  3. A person who assists an official in the exercise of his functions, or by reason of the fact that such person will assist or has assisted the said official;
  4. The other person by premeditation;
  5. The other person by employing torture or acts of cruelty;
  6. The other person for the purpose of preparing or facilitating the commission of the other offence; or
  7. The other person for the purpose of securing the benefit obtained through the other offence, or
  8. Concealing the other offence or escaping punishment for the other offence committed by him,

Shall be punished with death.

 

Section 95. Prescription

 

In a criminal case, if the offender is not prosecuted and brought to the Court within the following specified periods of time as from the date of the commission of the offence, the prosecution shall he precluded by prescription:

  1. Twenty years in case of offences punishable with death, imprisonment for life or imprisonment of twenty years;
  2. Fifteen years in case of offences punishable with imprisonment of over seven years but not up to twenty years;
  3. Ten years in case of offences punishable with imprisonment of over one year up to seven years;
  4. Five years in case of offences punishable with imprisonment of over one month up to one year;
  5. One year in the case of offences punishable with imprisonment of one month downwards or other punishment.

Maybe Noi did it.

 

Kittichai is listed as being 33 which means he's witnessed Thai justice for around 30 years.

 

Not sure I wouldn't have "run for my life", too - Given the likelihood I might otherwise (for reasons currently unknown) carry the can for another's crime.

 

Not saying he's innocent (how could I) just saying he's not yet been found to be guilty.

 

Just saying, is all.
