<quote>When you say marriage visa, is it a settlement visa or a visit visa which allows your girlfriend to marry?</quote>

I am a U.K. citizen and met my girlfriend (not Thai but I would imagine principle should be identical) in U.K. in february of last year when she was on a working holiday visa, she had to go back to her own country (Namibia) when this ran out in October, She then unsuccessfully applied for a student visa which was subsequently turned down, she then came for christmas as a visitor for a month, she has just returned to Namibia.

Our intention now is for to her to return to UK asap when we intent to marry preferably sooner rather than later, I would like to ask some questions iof thats ok

1. I am not sure what is meant be by the above quote, my very limited understanding is that the form we need to fill out is the VAF2 settlement Application form (presumably as the 'fiancee/proposed civil partnet of someone settled or going to settle in the UK), are you aware if my understanding is correct?

2. She has a 3 year old daughter, who is looked after by her parents, and is not coming to UK, I would not think that this should adversely affect her application, just wiondering, if after 2 years of marriage and her permanent settlement visa is granted, what rights does that give her, if she wants to bring her daughter to UK, or does this give her duaghter automatic rights to enter/stay in the Uk at a later date

3. This is a probably an old chestnut, but what evidence should we can we give of our intention to marry within the 6 month timeframe, other than my writing a letter, am not sure what more evidence I am expected to give

hope this is not to much, any advice would be gratefully accepted

1. If it's her intention to settle in the UK after her marriage in the UK then yes, apply for a Fiancé visa using the VAF2 form

2. The settlement entry requirements will also have to be satisfied for her dependant children.

3. Give as much details of your forthcoming marriage plans as possible.

I can undesrtand that, at the moment we intend to get married within the 6 month period after she arrives, however we have no formal plans where actual proof can be provided, I was hoping to start to sort the marraige business out after her arrival, so any advice how we can 'prove' this intention would be greatfully accepted

You will have to indicate your plans with bookings etc about your proposed wedding and also details about a place to stay, job etc. You wont get a fiancee visa in Bangkok just because you have 'talked' about getting married and I suspect that is also the case in Windhoek.

Otherwise you could go to Namibia and marry there and she can apply for a Settlement Visa

Will you marry at a church or in a register office? Which one? Are you going to have a big piss-up (if so, can I come?) or a quiet family do? How many people are going to attend? Who's going to be the best man etc?

These are the sorts of questions that will need answering to show that you have made some sort of plan for the wedding.

Scouse.
