A lawyer representing a doctor at a Nakhon Ratchasima private hospital who has been accused of sexually assaulting 11 factory workers during routine check-ups said on Tuesday that the allegedly damaged persons had asked for Bt550,000 in total compensation.


Lawyer Thanadech Srilamul said the case involved a criminal offence that could be settled and the workers had demanded Bt50,000 in compensation each. However, Thanadech said the sum was excessive but both parties were negotiating and the case would be settled if they could come to an agreement.

 

Thanadech also urged the public to be fair to the accused doctor, whose name has been withheld during the investigation, as the case had already tarnished his reputation and it had not been proven that he had intentionally done anything wrong.

 

He claimed the doctor had to conduct check-ups on many workers and a physical examination normally involved touching, while the doctor’s questions about the female workers’ personal information was a psychological tactic to relax them during the check-up.

 

The doctor is scheduled to meet police on Sunday to acknowledge criminal charges of committing an indecent act, which is punishable by imprisonment for up to 10 years, a Bt20,000 fine or both.

 

The 11 workers from the Siam Fukoku factory filed a complaint alleging that the doctor had needlessly touched their breasts during check-ups on November 17.

 

Each woman had gone alone into the examination room, where the doctor allegedly unzipped their uniform tops and felt their breasts. The check-ups were not supposed to include screening for breast cancer.

Should have just gone Cowboy and bought a lady drink if he wanted a fumble with breasts. 

 

Amazing if, in his position, he can pay compensation and avoid any investigation and court time for a criminal offence. He is a doctor for Christs sake

as long as Thailand allows the offenders to simply pay the victims money it will remain third world but here the almighty dollar is more important to everyone than justice. Fondle womens breast, pay them and they forget about it, kill a van load of people, pay the relatives and its forgotten, rape an under age girl and the parents  sell her to you or marry her to you, its all about money only, really is pathetic but its what happens here everyday and no one cares as long as they are being bought off.

In this case "justice" involves the doctor (who has not been proven guilty of anything yet) and the women who want paying, if both are satisfied then justice has been served, regardless of what uninvolved 3rd parties on ThaiVisa reckon .

If it is a criminal offense and not in the civil court system then it is a transgression against the moral fabric of the society ("laws");

To allow a settlement outside of the commonly understood definition of a criminal justice system is a huge flaw in the whole process;

No wonder thais have such little regard for laws

That's not what is happening, there is a police investigation and charges also.  It's not only what happened to the minor in the van case, either.  As for parents marrying off a rape victim to the rapist where was that reported or is that just folklore?

'Amazing if' being the salient point. If he avoids investigation, not he is avoiding investigation.

 

Once the compensation is paid the investigation may just disappear.

And we all know what will happen to that once compensation is received by the victims, in Thailand the investigation and prosecution tends to stop.

Who is complaining? Not sure if you have noticed but this is a chat forum for discussion, so twice you have misinterpreted other posters posts to fit your agenda, when called out on it rather than just keep quiet or admit to reading it wrong you decide to tell people to stop complaining when they are not complaining, merely offering an opinion.

He needs to be suspended pending an investigation. There should be no settlement to avoid losing his license and being in prisoned allowed. If found guilty, license gone forever, hefty prison sense because of his position and a big payout.

Arrest him, question him and if enough evidence charge him and ensure he is kept away from women patients until after his trial.

If he did as is alleged, justice will only be done when he is put on trial for sexual assault, gaoled and banned from ever practicing medicine again.

I didn't "tell" anyone to stop complaining, I said, to you specifically, without misinterpreting your comment only that there was no point in your complaining about the application of Thai law in this case.  It is you who is reading things wrong.

 

Incidentally, what is the  "agenda" that you accuse me of having?

Your agenda seems to be to flit into a thread and dispute every post, and insinuate things in posts that do not exist. take a deep breath, read the posts properly, then we can all get along happily.

No, don't expect to be able to do that if you keep addressing comments to me specifically. 

 

Do you remember your post #16 where you agreed that this is a forum for discussion and opinion?  Does that only apply to your opinion, then, or am I also allowed an opinion that may differ from others?  My reading of the posts is, ironically, a lot more accurate than yours and, as this is a discussion forum amongst other things it is somewhat naïve to expect everyone to "get along happily".

As you well know, that's not what I said. 

 

Thai law does, however, in certain circumstances, allow for agreements for compensation to be paid to victims of crime who may decide not to insist on charges being made as a result of those negotiations.  If we, as foreigners don't like it, that's just hard cheese.

No, justice isn't served merely by someone bribing their way out of a criminal offense.

 

Justice is served when society at large can see that people who engage in criminal conduct are actually punished in accord with the severity of their crime and Thailand's criminal code. Then people can see that justice can be had for all, and that money isn't simply an eraser for all crimes.

Wow, it seems I am not the only one in this thread reading you correctly, are we all incorrect about your posting style?

 

Clearly your reading of posts is not as good as you think it is.

 

Anyway, you just carry on as you are if you choose to, I was correct, it is all about opinions however if you disagree with someone else opinion I suggest you deal with what the opinion actually is, rather than what you wish it to be to fit your agenda.
