Hello,

 

are there any special licenses required to form a company which will hire a doctor + nurse to offer botox injections? Does the company itself need to have some sort of license or will the doctor's license be enough?

You need a licensed premises. To get that, you need to set up a Thai company, get your premises, fit them out and equip them, and find a Thai Doctor that will hold the license for you before you will be granted permission to operate.

 

You will be spending a lot of money in advance. Once you have done that, there is nothing to stop the Doctor asking for a bigger cut or else he goes and takes his license with him, leaving you unable to operate. Also, nothing stops him using your clinic to build up business, then divert it away to his own practice later.

 

On top of that, of course, you will only be able to own 49 per cent of the company (unless you are American).

 

If you have lots of money to spare, it can be done. Finding the Doctor will be the hardest bit, as you need him and he doesn't need you.

From my understanding the doctor holds his license for himself to operate for the company and in the case he does not want to work anymore, he can be replaced by another doctor which also needs to apply for a license to work for this company.

 

Or does it mean that the license granted for the company based on the premises is tied to this one doctor and if the doctor is changing (e.g. getting a second doctor who also gets a license for himself to work for the company), the license for the company/premises must be done again? This would be a real deal breaker, but I doubt it is that way.

 

And yes, without a doctor customers cannot be served. But why the doctor does not need me? I mean, it is kind of philosophically, because it's about money and not about personal attachments, so either he wants to make money or not.

You need a minimum of one doctor linked to your company/premises. You can of course have more.

 

If your premises license needs to be renewed and you have no doctor at all (you have to supply copies of his medical license, ID card, etc with your application) then the premises license will expire and you have to start again with a fresh application.

 

The doctor won't need you because they can work in any clinic or set up one or many clinics of their own. Doctors are not short of cash, or friends willing to invest in them.

 

You won't be offering them anything they can't get elsewhere (unless they are dreadful).

So basically if the first doctor who is used for the first time license decides to move on, the company license won't be revoked until the company license is due to renewal. This is a good info, thanks.

 

Do you know how much the license for the doctor to work at the company costs (not the company license).

I don't sorry. You need to give the Ministry of Public Health a call for more in depth information.

If you are Russian you might be in need of some FBI clearance? That whole sex clinic stuff from a few weeks ago put a damper on things here in Pattaya! ??

worst case scenario.  would it not be wise to do a contract that details the obligations and minimum duration for the doctor. any decent contract contains significant penalty clauses

The problem about most contracts in Thailand is what are you going to do when the other party doesn't perform?

 

Court is expensive and time consuming. It's going to take about 10 years to get a final judgement, which you have to pay for every step of the way. At the end, there is little probability of actually receiving any money because any assets will long since have disappeared into children's names, etc.

 

Anyone looking to scam you already knows this.

Wen you are not a doctor ore a specialist in giving Botox and you only go for the profit, i hope you never get a licence, don`t fool around on healthcare
