I was hoping to get some assistance on Thaivisa forum, as i am a bit unsure of my next step to the below issue. Let me just explain and hopefully there is someone who could shed some light.

 

I have been living in Thailand for 8 years, and my 1st visa was a thai spouse visa for 2 years.

I then began full time employment roughly 5-6 years ago. My company has provided the work permit, and also the non-b visa.

In June this year, i will resign from my position. I then have the following questions:

 

1/ What happens to my work permit? I assume it is cancelled, as it expires in June 2019.

2/ If my work permit is cancelled, does my visa also get cancelled?  My non-b visa will expire in January 2019.

 

 I am concerned about a trip back home in August. If i resign from my job and my work permit is cancelled, i don't want it to effect my visa before traveling. I assume my visa will not be canceled before it's expiry date, regardless of the work permit. Would my assumption be correct?

 

I would appreciate any feedback, and if i am not clear enough then please ask.

Do you actually have a valid visa obtained from a Thai Embassy/Consulate or an extension of stay obtained from a Thai immigration office? 

If you had a valid multiple entry non-b visa issued by an embassy or consulate it would remain valid.

I think though that you have an extension of stay based upon working issued by immigration that ends when your job ends.

Thanks for the reply. I have an extension of stay from the Thai Immigration office, that my company arranges each year.

Yes i have an extension of stay visa. So if this expires when my job ends, does it mean i have to apply for spouse visa immediately? I am concerned about going back home for a holiday, and then returning. What solution could i have here?

You could change the reason for your extension of stay from working to marriage when your job ends. You would need 400k baht in the bank for 2 months or proof of 40k baht income.

If you leave the country and don't get a visa while out of the country you would only get a visa exempt entry.

Could you please explain the visa exempt entry? If i resigned at the end of June, and my work permit and visa is cancelled, then i didn't apply for a new visa immediately, can i leave the country in August and come back and apply for spouse visa?

It is a 30 day visa exempt entry for those that are from countries that qualify for one.

It would be best if you applied for a single entry non-o visa based upon marriage at an embassy or consulate while you are out of the country. Then you could apply for a extension of stay based upon marriage.

To be sure you would not have problems for not having your extension canceled you could have your extension formally canceled and apply for a 60 day extension to visit your wife.

Sounds like a lot of messing around, so i think my solution below may be more suitable?

 

 I could extend my resignation date from my job until the end of August after i return from o/s. That way, i can simply change the reason of my extension of stay to spouse visa, and by then have the 2 months of 400k in the bank.

Sorry, i have some more questions. How long does process take to change the reason of extension of stay? If i had the 400k,  i suppose i will need all of the documents required to change it? Will it go under consideration, or an easier process as i am just changing the reason?

You will have to supply all the required documents needed for a extension based upon marriage. You will get a under consideration stamp.

No difference between changing the reason for your extension and doing one for the first time.
