I need your assistance regarding my visa and work permit.I was working with another company till 30th June 2018, but my visa and work permit with that company was till 30th August 2018. I got some issues with my boss and I decided to quit the job and made an excuse that I am going to my home country for a month for some personnel issues. My last employer told me he will not cancel my visa n work permit till 30th August, but recently when i got a new job and went to meet him an ask for documents so that I can transfer my wp and visa, he told me he already took out my name on 30th June from the company's log books and has not paid my taxes for this month.Is there any way that my old employer can put back my name on company's tax books for july so that i can apply for my new visa without leaving the company,(as asked to leave the country as I won't be able to cancel and apply for new visa n wp on the same day)????TIA

Work permits and extensions (not a visa) cannot be transferred. Both have to be canceled before a new one can be applied for.

You would only need a termination letter from you former employer to cancel your extension and then apply for a new one with supporting documents form your new employer and work permit application approval letter. After getting the extension your existing work permit would need to be canceled and the new one issued.

I totally understand this, but the problem is my last employer did not pay my tax for this month and he is not ready to sign on a termination letter dated 30th July (which means this month) , so that I can cancel and apply for a new wp on he same day. In other case, I have to leave the country which I don't want to. Is it possible for him to put back my name on his company's worker names so that he can issue me a new termination letter at the end of this month, so that I can cancel and apply for a new one on the same day?

Please don’t focus so much on the not paid tax for one month, it’s irrelevant now. You wrote in your earlier post that the last day of employment regarding your employer was the end of June?

 

That would be the time when your overstay starts. Please be careful, you’re in very dangerous waters and on very thin ice now.

 

 

 

Try to be nice to your ex-employer, the letter means a lot to the immigration's decision. But it seems that he already knows that you were trying to play him out. That's the result of not being honest.

If not paid tax is not a big deal, then why my last employer is not ready to sign on the documents that states that i will be leaving his company on this coming 31st July? Hr from my new company asked me to do so, so that we can cancel and apply on the same day. Although I started working in the new company from 1st July, but as I was assure about my visa n wp, so I did not applied then. But now I want to change, and this all is happening now.

Okay, fair. Why don't you make an offer that you'll pay for the tax? it won't be a lot anyway and it's possible to pay tax afterwards. 

 If I were you, I'd try all that my ex-employer pays the tax and gives me a letter stating that my last day was the 31st of this month. The immigration wants that letter, as well as the cancellation of the work permit. 

P.S. I'm not sure if you can do the cancellation and application on the same day. Without knowing the circumstances, there's a possibility that you've got to apply for a new Non-B visa outside of Thailand. It all depends on the Immigration and they are all a bit different with their rules and regulations.

I already gave him that offer, I said I will bear all the tax, no problem. But then also he is worried and not ready and he told me that he has taken out my name from the company's log books or whatever which states the name of the employees.My problem is I don't want to leave the country as it is a hassle and very expensive as well.

 

Is it possible for the employer to re register my name for the month of July as the employee of that company?

From my knowledge, it is possible to change the "log book", or whatever you want to call it. He can add one more month if he wants to. But he won't do that for you if he's pissed off. Please think about an eventual overstay now.

You're welcome. He knows that you'll be in deep <deleted> if you don't get the letter stating the right date for you. And that's what the immigration wants to see, plus the termination of your work permit. The immigration can't cancel a work permit, it has to be done at the labor department.
