Five face charges for Phoenix, Serenata sinkings, Phuket Police Chief confirms

PHUKET:-- Phuket Provincial Police Commander Maj Gen Teeraphol Thipjaroen today confirmed that five people are currently facing criminal charges of negligence for the Phoenix tour boat disaster on July 5 that killed 47 Chinese tourists. The Phoenix capsized and sank off Koh Hei (Coral Island) in a storm squall on July while carrying 89 tourists on board.

 

Gen Teeraphol delivered the news at a press conference held at Phuket Provincial Hall today (Aug 7) in the presence of local and national media as well as reporters from major news services in China such as People's Daily and state news agency Xinhua.

 

Gen Teeraphol opened his address with explanations of the current state of ppolice action in the incident involving the Serenata tour boat, which capsized near Mai Thon Island also on July 5, but with no fatalities.

While there is no denying it was a tragedy, can anyone confirm regarding "causing physical and mental harm to other people by committing an act by using a vehicle (boat)"? 

Or is this an ad-lib law the police are making up as they go along?

‘Serenata’ captain and company manager charged

A law suit has been filed against the Serenata’s boat captain and the Chinese marketing manager of the company that owns the yacht. The Serenata was found to be of alleged ‘defective maintenance’.

 

Serenata sank on the same day as Phoenix, July 6, but didn’t suffer any casualties with all passengers saved.

 

Phuket’s Provincial Police commander Maj Gen Teerapol Thipjaroen says… “for Serenata, a criminal case has been bought against the 56 year old boat captain Maeta Limsakul for committing an act of negligence causing grievous bodily and mental harm to other persons.”

Being cynical, I would suggest the "mental harm to other persons" are the government and TAT, all worried about the loss of face & income from cancelled bookings by Chinese tourists, and the potential knock-on effect it might have on other groups.
