Ok,

So i got the visa in October, Got married on Saturday. Now i have a month before her visa runs out.

What do i do to get her to stay here in the UK? I need her to get a passport here, a work permit and most of all the visa extended.

Could any one please help. Links to forms and information would be very much appreciated.

I would ask my brother but he has gone to Thailand.

On the assumption that your wife entered the UK on a fiancée visa, she should make an application to the Home Office for an extension as your spouse. The application form can be found here. The application costs £335.00. The Home Office's guidance on the requirements can be found here.

Are you sure that is right Scouser?

It says

"We need documentary evidence indicating that you and your partner have been living together as a couple during the

past two years. Ideally, this evidence should indicate joint commitments in your finances, other responsibilities and

social activities spread across the past 24 months/2 years."

How is that possible when she only has a 6 month visa?

And how the hel_l am i supose to supply all of that information? I thought this was about her not me.

Hmmmm I'd say a settlement visa would be the next step. What sort of visa is she on now?

We applied for a settlement visa.

I have just looked at her passport and it has a piece of paper in there saying marriage visa. So now where do i go?

If it's a marriage visa then you only asked to come to the UK to get married, which you have done, now she must return to Thailand. If she wants to live in UK she must then apply for a settlement visa to return.

Or is it a fiancee visa then it's as scouse said above

It's not a settlement visa as it would be valid for 2 years or are you reading that she must enter UK within the 6 months from the date of issue of the visa?

Then it's a fiancee visa, she doesn't have to return to Thailand, you dont need a WP just follow the guidance given by scouse in the earlier post.

What do you mean she does not need a WP (work permit). She has to be a UK resident i thought.

You are reading the wrong part of the form. That comes from Section 6c which relates to unmarried or same sex partners. Ignore it, it doesn't apply to you.

You only need to provide the documents from sections 6a and 6b that are relevant in your case.

Remember, though, that in two years time she will need such documents when she applies for ILR. So start collecting them now.

Once she has her FLR as your spouse she will be a UK resident and so does not need a work permit.

When you make your application for her 'Leave to remain' in UK and it is granted she will be resident. She can then live in UK with all the benefits of a British citizen except vote (if thats' a benefit!). She has freedom to come and go to UK, she has free access to NHS and she can work but you must first get her an NI number from your local job centre.

Not quite. She will still be proscribed from accessing certain public funds until she has ILR.

Sorry, other way round. The DWP will not issue her with an NI number until she needs one, so she should get a job first. Although she may be able to get one before she has a job if she has some other reason for needing it, your claim for WTC for example.

Thanks for all o your response's.

I have printed off the forms and shall be filling them out soon.

How many weeks before her visa expires should i wait before sending the form off. Her visa expires on the 25/03/07.
