Hello, Can I convert my non-immigrant visa under boi to marriage visa? The reason is that I would need to stop in working (Please don't ask why I need to stop working ????), that means my current company will revoke my work permit together with the visa and I would need to leave Thailand within 7 days. It would be best scenario if I can get marriage visa without leaving Thailand under my circumstances. It seems logical to me (but need to confirm) that if I can converted my current visa to marriage visa, the company can only revoke the work permit not the marriage visa.

I reviewed all other requirements and I have no problem fulfilling those.

I really appreciate some guidance. Thanks in advance!

In theory, yes. As you have non immigrant visa there is no reason why immigrantion can’t issue you with an “marriage visa” (extension of stay based on being married). However, they might insist you leave the country an get a new category ‘O’ non immigrant visa.

 

It’s worth asking at you local office.

You would have to cancel your current extension and then apply for one based upon marriage.

If the extension you have now was issued at the one stop center you would have to cancel it there and then apply for the extension based upon marriage at you local office (Chaeng Wattana if living in Bangkok).

Thanks. Good to hear that it seems possible. I would definitely find time to go to chaengwattana.

Thanks @ubonjoe I would consider this a Yes answer? Do you mean I need to cancel first before applying for marriage visa? Is this a personal experience or you know someone? It posed potential issue. First, Can one stop center cancel it without new visa? It seems I am out of status if that is allowed. Second, what will happen if I apply marriage visa and not approve or delayed? How can I stay with no visa?

It is a yes answer and is how it has to be done. You would not be applying for a visa.

You cannot change the reason for your extension of stay without first canceling the existing one. Others have certainly done it.

Canceling your extension at the one stop center and then going to Chaeng Wattana on the same day to apply for the new extension is possible.

One way to do it is go to the one stop center a couple of days before the date your job ends and they would post date the cancelation of your extension to that day that gives you more time.

If you had a problem getting the one year extension application based upon marriage accepted you could apply for a 60 day extension to visit your wife to get more time to apply near the end of those 60 days.

If your application is accepted and the 1900 baht fee is paid you will get a under consideration stamp with a report back date 30 days from when your application is accepted. The application has to approved by Immigration Division 1 if applying at Bangkok.immigration.

Really appreciate this @ubonjoe very informative. My employer control the date when they will cancel my wp/visa but I will know because they will ask my passport. Since I still have 7 days allowance if stay once wp/visa is cancelled, then that means I still have time to go to chaengwattana and apply for extension. One last question, assuming I will get the under consideration stamp, does that mean I can legally stay in Thailand for 30 days more? Then assuming again Immig Div 1 did not approved after 30 days, then I need to leave Thailand, am I overstaying?

Not sure how the one stop does the 7 days. If it is stamped as 7 days to leave the country you could not apply for an extension.

The under consideration stamp allows you to stay until the extension is approved or the very rare occurrence of it being disapproved.

If your application is accepted there is about a 98% chance it will be approved. If not approved you would be granted 7 days to leave the country (no overstay).

I can't thank you enough for the quality of information. Only thing I need figure out now is if one stop will stamp 7 days to leave the country. That will change the game for me. I think many here have experienced going to one stop center and wp/visa cancelled. Maybe they can share what they got when they got cancelled.

At the one stop center applying for an extension and having it denied is not required. They grant 7 days to allow a person time to leave the country or make other arrangements.
