registration with SEC and taxes?

I'm trying to clarify info regarding Royal Decree from May 2018, and could not find anything on this forum.

 

- Do individuals who buy/sell crypto on local exchanges need to register with SEC? As I understood, it's not considered dealership or brokerage, but wanted to make sure.

 

- How do you calculate overall capital gain from multitude of trades? Does any local exchange provide such info to their clients or to tax authorities? I.e. is it expected to receive a tax bill similar how IRS sends their evaluations to US crypto users, or you have to calculate everything and turn yourself in?

Indivdual investors do not need to be registered with the SEC in Thailand only legal entities, however registered legal entites (only 7 in Thailand currently) are required to have KYC polices with investors so by extension, the SEC knows who you are..

 

Current csptial gains tax on cryto in Thailand is 15% and its your responsibility to sort your own tax out, the likes of BX in Thailand will provide tax receipts for the fees paid and you can download a spreadsheet of all your transactions.

 

I dont know about the other registered exchanges in Thailand, but certainly Bx in Thailand doesnt allow US citizens to trade on their exchange (read their T&Cs)
