Sorry to post again on this topic, but I'm beginning to get rather worried about my options regarding a visa/visa extension!

A quick summary:

- British, 47 years old, degree and Masters, legally married to Thai lady, natural Thai son in Thailand.

- Living in Thailand for almost 5 years using multi non-imm B visa issued by Hull, UK

- Never worked in LoS, (UK income). But have owned Thai ltd business and now am 49% shareholder in Phuket 'bungalow resort' with my wife

- Keen to get visa extension so that I can start on PR route. But will consider any options right now!

Visa-extension options that seem not viable:

- Work in my hotel as manager and get extension based on that WP. I went down this route, but have been advised that my WP will not be issued until our resort has a hotel licence, as issued by the local OrBorTor. However, OrBorTor is very happy with our business but in no hurry to issue licence! (Not enough tea money offered....)

- Get extension based on support of Thai wife. Also not practical now. My wife is mentally ill and in a Udon Thani hospital 1000km from me. She cannot attend the immigration office. (And our business is very new, so we may not be able to satisfy business auditting/financial requirement anyway.

Greg suggested getting a 90 day visa to visit my Thai son. That's one option (thanks Greg!), but I'm keen to understand if there are other options for visa-extension, long-term stay.

What about a visa-extension if I follow a grad/post-grad course in LoS? How many hours per week would qualifiy me for applying for this?

And any other options??? I have 4 weeks to sort out a solution... (Returning to the UK for another non-imm B visa is an expensive option for me, and Hull might not issue this in the current climate to someone who is not working in Thailand)

It is in fact a 60 day extension not a 90 day extension.
What about a visa-extension if I follow a grad/post-grad course in LoS? How many hours per week would qualifiy me for applying for this?

30 hours of school per week.

Go to Hanoi. Show your work permit and get a one year multi entry visa.

Sunbelt, I remember your mentioning once the work permit for consultants. Would this be an option for Simon?

Or temporarily, while his wife is in medical care – Simon, my sympathy – 90-day extensions for taking care of an ill relative, until she is well again?

Greg, no WP! They will not issue it until we have the hotel licence. (A friend near me just got their hotel licence after operating their hotel for 6 years!!).

Simon, my husband applied for our bungalow/reosrt license over a year and a half ago. Still waiting.... :o

Or bor wha dor is what my husband calls that office.

Anyway, would a letter from your wife's doctor be acceptable by Immigration in order to apply for a marriage visa extension?

Hi Sheryl, I seem to read before that for a marriage visa extension, it is absolutely compulsory that she attends with me at immigration, and that they maybe come and confirm that we are living together. But I'll speak with her doctor tomorrow also..

How could you be a Hotel? You have less than 12 rooms( Thai definition of a Hotel is more than 12 rooms)

The company objectives should not state "Hotel"

The objective simply cannot state Hotel then he should be fine. Simon, you better get a Work permit ASAP with you running the business now.

Police Order

7.24 In case of entering for receive the medical treatment or rehabilitation, or taking care of patient.

Each time of permission shall be granted for a period not exceeding 90 days.

Criteria...

(1) The Applicant is requested by the doctor of the hospital where the patient is nursed.

(2) In case of entering for taking care of the patient, the applicant needs to be approved and requested by the doctor of the Hospital where the patient is being treated, or by the Embassy or Consulate.

(3) In case that the person who will take care of the patient is not a member of the patient’s family, the permission shall be granted for only one person.

Proof needed...

1. Application form

2. Copy of the applicant’s passport

3. A certified letter or the request issued by the doctor of the Hospital where the patient is being treated.

4. Only for the case of entering for taking care of the patient, the certified letter or request issued by the doctor of the Hospital where the patient is being treated, or the embassy or the consulate shall be attached to the application form.

Correct. Plus how would you show proof of income with you not having a work permit and then your wife is in the Hospital. ( I understand she could still be filing a PND #1 for herself but will Immigration believe it)

The best way is 7.24 of the Police Order. Well done Maestro for pointing that option out.

Greg, thanks for your comment. Yes, we are not ahotel since we only have 10 rooms. But the OrBorTor insists that we get a hotel licence! Maybe a local lawyer can sort that one out...

re the 7.24 order, that sounds very good! Could IO get a visa extension on that basis, (as opposed to having to leave LoS in order

to apply under 7.24)? Also, assuming after 90 days that she had recovered, would I then be able (for example), to apply for another visa extension using one of the more common reasons, (eg, if my wife was filing tax returns by that date).

Simon. You could nip to KL and get a multi-entry non-o based on visiting Thai spouse. No financial requirements (at last report), still allows you to get a WP against it.

Will buy you some time :o
