Could someone advise on this query please? Once the first period of FLR is complete after 2.5 years do you have to apply for ILR if you are eligible or is it possible to apply for a further FLR period of 2.5 years? If it is possible, do reasons have to be given for opting for FLR and not ILR? ( IE not achieved B1 English etc )or is it the individual's choice which they apply for?

Whilst various governments have from time to time talked of limiting the number of times someone can apply for FLR, as far as I am aware this has just been talk and not yet come to pass.

 

Obviously it is best to apply for ILR as soon as qualified.

 

But, as you say, that may not be possible because one may not, for example, have the required English speaking and listening grade or not passed the LitUK test or one delayed initial entry to the UK for more than 3 months so one had not lived in the UK for 30 months when the initial visa expired and one applied for FLR and so have not lived in the UK for 5 years when this FLR expires.

 

So one can apply for another FLR instead of ILR. Remember, though, that the required English speaking and listening grade for FLR is now A2. Then, once fully eligible one can apply for ILR without having to wait for this FLR to expire.

 

I am not aware of any need to say why one is applying for FLR rather than ILR, but if asked simply say why.

 

I hope this doesn't apply in your case, but if the reason for not applying for ILR is that you don't meet the financial requirement, then any FLR application will be refused for that same reason.

Why would you apply for FLR if you are eligible for ILR?

 

If you are eligible for ILR, apply for ILR; save you a lot of money in the long run.

Thanks 7 for your help. The financial requirement part is ok. I was just wondering really if FLR can be extended within the rules. I take on board what you said about cost, that if you don't go straight to ILR, it ends up costing another £1600 approx for FLR. Thanks again for clarifying.
