Boy dead. Insurance company not wants to pay.

I would say who better to ask for advice from than another insurance company.  If the family has any kind of an insured vehicle I would definitely consider approaching that company to explain the situation; and, get their take.  A good insurance broker can probably help as well.

 

@geriatrickid: factfinding necessary indeed, that is number one on the action list. Right now I only know some headlines, based on a few phone calls with a sad grandmother during the last few months. She is walking against a brick wall and can need some assistance. That is where I come in.

 

@CMBob: see my answer above to geriatrickid: you are right: factfinding first. I agree with you, that it will be difficult to get money from the driver, if he is 100% personally liable. We will contact several organizations, who might help us or give us some good directions.

Seems to me that with 500k baht on the line, the family should find a good attorney willing to work on a contingency basis (usually for a bigger percentage cut of the proceeds) with no financial outlay on the part of the family for legal costs; the attorney carries the (calculated) risk that he will ultimately be successful in pursuit of a settlement of some kind.

sad story--another 'typical corrupt insurance company...it seems.

Unlikely I would think, if Thai insurance companies are anything like the UKs, they will try everything not to pay out.

Best way....Ask Bangkok Post initially to publicise this issue, then go to all the Web sites ie Facebook and show them up etc, its all about face in Thailand.

HE is responsible and if his insurance doesnt pay , it is his problem

Very, very difficult (and possibly dangerous) thing to do.

Complain to the OIC and try to get insurance co to pay out is best approach, at least initially.

If it turns out that for some reason the insurance co is not obligated to pay (driver was intoxicated, policy lapsed etc) then t try to negotiate a payment schedule in installments with the driver.
