Two jailed for seven years, fined Bt6.3m for violent assault of 28-year-old man

The Criminal Court on Tuesday sentenced two men to seven years in jail and a joint fine of Bt6.349 million for violently attacking a victim, who later had to have a leg amputated.

 

The court found Thanayuth Khanthong, 20, and Suksan Noksiri, 24, guilty of attacking and seriously injuring Kulthawat Wisit, 28, in the early hours of November 22, 2017.

 

The two had been charged along with Thanaphak Suphanphesat, 21, Piyachai Sirisamansak, 26, and Phumisak Siriraj, 26.

 

The court acquitted Thanaphak, Piyachai and Phumisak on grounds that although they had followed Thanayuth and Suksan to the scene of the attack, they did not take part in the assault.

 

Kulthawat is a son of a police lieutenant-colonel working at the Police Education Bureau.

 

The court ruled that accounts given by the owner of a bar and security officers pointed to Thanayuth and Suksan having attacked Kulthawat. 

 

The victim also told the court that he had clearly seen the faces of his two assailants.

 

The court was told that Kulthawat had gone to drink at the Sam Lor Bar and Restaurant on Soi Shinnaket 2/26 in Bangkok’s Lak Si district at 8pm on November 21, 2017.

 

Then, when Suksan had been involved in a brawl with a group of drinkers at 11.30 pm, Kulthawat stepped in to try to stop the two groups from fighting.

 

Suksan, who was hit in the face during the brawl, was asked by the bar owner to leave. 

 

The court was told that Suksan then returned with friends to wait for Kulthawat to leave the bar.

 

When he eventually left the premises at 1.20am in the morning, Suksan and Thanayuth and three friends drove their motorcycles after Kulthawat, who was also on a motorcycle.

 

The court heard that Thanayuth then kicked Kulthawat’s motorcycle, causing it to topple over, leaving Kulthawat unconscious on the ground.

 

Thanayuth and Suksan then repeatedly kicked the victim in the head and torso before his motorcycle caught fire, burning both his legs so badly that one later had to be amputated.

 

The court ordered Thanayuth and Suksan to jointly pay compensation of Bt6.349 million to Kulthawat, as well as each serving a seven-year jail term.

Excellent news that vicious thugs are going to jail, but realistically, how are they going to be able to pay the compensation? A 20 and a 24 year old pair of scumbags are unlikely to have two brass cents to rub together, and they won't be earning much in jail. In the meantime a man is crippled. When will the state pay such compensation and then pursue the miscreants for repayment?

Presumably the only reason they wound up doing time for this. 

Too bad the offenders parents aren't rich. Also helps that the victims father is a cop. If it were otherwise, it would be a 500 baht fine and a wai.

To add to that, I don't think I've ever seen 6.3m baht fine here. These knuckleheads kicked the wrong motorbike.

Really.  Had the victim been a farang it would have been a 5000 THB fine and a wai.  I still remember that 67 year old woman being sucker punched into unconsciousness in Hua Hin.  <hand slap, hand slap>.
