What happened if a foreign child is caught on overstay in random check while the parent is on legal visa?

Hello,

 

What if a random Immigration Bureau check come and see a foreign child is on overstay while the parents are on legal way on the visa (no overstay) ?

 

Do Immigration will sent the parent & the child to the Immigration Detention Center ?

Those under the age of 16 yrs (i.e. 15 and under) are exempt from fines for over-stay.

Any overstay is just cleared at Immigration without the fine, but still get an overstay stamp.

 

Those under 18 years old are exempt from being banned if caught.

 

But, an alien Child without a Visa is an Illegal Immigrant - thus, you ask a good question, what would happen?

It is under the age of 15 not 16.

A lot would depend upon the age of the child. A parent is responsible to insure their child stays in the country legally but I doubt immigration would detain them or the child.

Probably a serious warning to the parent to rectify their child's overstay.
