Getting My Son Away from his Mother

Since my son was born some 8 months ago, my relationship with his mother has spiralled downhill...

 

In my opinion she is not fit to be his mother, I won't go into detail but I seriously worry for him.

 

I know our relationship is coming to an end after almost 10 years and we will end up divorced, but I love my son and it will break my heart to leave him and especially with his totally irresponsible mother.

 

I know i won't be able to get him out of the country because i would need his mother to verify his passport application. This won't happen. But I am toying with the idea driven by desperation of just taking him away to another part of Thailand where i can look after him a lot better than his mother ever could.

 

In Thailand can a father kidnap his own son?... If his mother was to take him away from me without MY permission would that be acceptable in Thai law?... And if the two are different, why are they different??

 

Please only bother to reply if you actually know what you are talking about... So many on this forum have no clue what the actual laws are on this but will spout a load of BS regardless of what they think it would be which is not helpful to my situation.

You definitely need to speak with a family law expert, your embassy and see what supports you have.

You should also document evidence of your allegations regarding the woman being "unfit" when you seek that advice

The first thing they will advise you is record everything, note everything, dates, times, events - No emotion, just fact. 

 

Get your son his 'other' National Passport - do what ever it takes to secure this. 

 

Do not take your son out of the country for long term or 'kidnap' him within Thailand - this may be viewed upon poorly by the courts in any custody hearing.

I am sure this is not what you want to hear but it the truth: I know a relative rich farang with 50/50 2 kids. He had also major problems with his wife about the kids. At the end he paid her a couple of million baht to basically make sure he takes care of the children and the Thai mother has no rights anymore. This agreement was made in front of a Thai judge and is legal.

It seems at least for him this was the only way he could guarantee that he takes care of the children and not she.

His wife shall root in hell for 'selling' her kids!!

Had a friend in the same situation. The arguments went on for a long-time. At the end some cash to the "bg."-mother and she handed over the daughter, don't know all details, but family court or such signed off on it and the girl lives in Europe with her father. Mother back in the bar.  But definitely get a good lawyer involved, I prefer local lawyers, where the case is taking place, as they know the relevant local authorities. MS>

My wife's family look after a 12 y o girl who is the nephew's daughter. My wife paid off the mother and took the girl when she was 6 months old. The mother still turns up and gets money now and then and the young girl seems very happy with her surrogate family. Maybe you can come to a financial arrangement with the family.
