Complex Visa Issue / Question

Firstly can i start by saying i cannot be too specific on some points as it will be blatently obvious who mr farang and mrs thai are so pm me or email i think that can be done, im new to forums but i was told by a friend this is the 1 and only place ive got a chance of finding out the info so here goes.

thai girl meets uk man who is 10 years older in 2002 the man visits thailand a few times she gets visitors visas comes to uk and isnt happy so goes back and forth from thai to uk quite a lot and they have a few visitors visas then a fiancee one. eventually convenience marriage takes place end of 2004 so she gets a proper visa but girl is still unhappy and returns to thailand and they break up a few months later, uk man says he will go see her end of that month but is spotted in thailand beforehand with another girl who is identified and admits to sleeping with uk guy. the couple meet to discuss the problem and decide to breakup uk guy goes home.

thai girl goes out to disco meets nakmuay who is 6 months older than thai girl they get on well and spend 6 weeks together, the final 2 on an island where they finally 'got it on' shall we say, nakmuay met the girl in a pay entry disco not a bar can i point that out please nakmuay is not a sex tourist not that there is anything wrong with that but he was in thailand for other reasons at the time nakmuay knew nothing not even what a bar fine was as he hadnt been to those places due to not really being allowed out in thailand lol, no money was ever exchanged between the two at any point, obviously nakmuay paid for everything bar the girl getting taxis to meet him but that happens over here to a certain extent.

nakmuay offers to pay for thai girl flight to uk to come see him for a holiday and books an open ticket so if things dont work out she could return in a matter of days or if they did she could stay for 6 months (duration of ticket) nakmuay is aware thai girl had been to england before but until thai girl had been living with him for a month didnt realise she was married to uk guy, there were no dramatic sob stories, nakmuay was young and knew nothing not even that she needed a visa to come to the uk (i know stupid, hence a nakmuay!) anyhow they get on well and she has no other secrets to reveal thank god and they live together until Jan 2007 when her 2 year visa she got from being married to uk guy ran out. while she was with uk guy she returned to thailand a lot and did relatively little bar find another thai woman to go eat and gossip with. when she was living with nakmuay she started to learn to drive, got a bank account and worked full time for a department store and any money she sent home was her own but was relatively little, she paid for all the food in the house and did the household duties and couple had a pretty much western relationship she chipped in on bills only thing she didnt pay was rent.

nakmuay tries and fails to research visa laws on home office websites, and eventually gets back out to thailnd to stay with her for the whole of march. the couple have now been together and have evidence of being a couple for 20months, uk guy and thai girl have not seen eachother at all in those 20 months. nakmuay and thai girl have contacted uk guy to try and sort out a divorce as they have not seen eachother in over 22 months and could surely divorce easily soon under 2 year desertion as they havent been in the same country for any relationship to have taken place plus any time she was in the uk she was living with nakmuay and didnt spend a single night without him. uk guy wants cash or will drag heels on divorce. From being very stupid and knowing nothing nakmuay began to read books about thai western relationships etc and became wary and started to check up on things make sure the relationship was as good as it seems, several operations recording conversations and having them translated etc and thorough checkups on thai girl proove it to be surprisingly genuine considering all the sob stories nakmuay has recently read about and tales from people who had previously got stung shall we say.

these are the points that need addressing that nakmuay needs help with...

a) if seperated 2 years which is this May can uk guy stop or hold the divorce?

B) can thai girl get back in to uk to see nakmuay ever and what sort of visa would it be? visitor? they have known eachother and had a relationship for 2 years this july, is it a different visa?

c) is the only way of them being together for nakmuay to move to thailand?

d) what does nakmuay need to provide paperwork wise and who to? meaning does he need to go to thailand to sort it out or can it be filed from england, will thai girl have to have decree absolute?

if you can help or make positive comment please pm or email this isnt on here to get a million posts and views off of micky takers, sorry if its hard to follow or the grammer is poor, not the sharpest tool in the box but getting there.

a) I would think if no one is acting for her in UK the UK guy can drag his feet for ever, Nakmuay must act for her or get a lawyer as she no longer has a valid visa to return to UK to help herself.

b.) She can return to UK (relationships do go sour/people change their mind etc) She should apply for whatever visa she wants. If she wants to visit as a tourist then apply for a tourist visa, if she wants to try to settle again then try for a settlement visa. Whatever she applies for she must address the fact that the other relationship went wrong and why she abandoned the settlement opportunity.

c) No

d) Read UK Visas site with particular reference to the checklists and sponsors requirements. It would be wise to have the decree absolute if applying for a settlement visa, it can be done with a Nisi in special cases but you dont want to make life any more difficult than it already is. Nakmuay does not have to go to Thailand if his G/F is sharp enough to do it alone. He will be her sponsor and he can send sponsorship papers to her to present with her application.

When she gets the divorce then scan this forum for hints, links etc to apply for the visa she decided upon. You should keep all the proof of your relationship and living together as that will evidence of your relationship when you do apply.

Bluddy tough read, you should learn the art of punctuation as a minimum.

I know you said you can't be specific about certain points but there are some issues you should provide details on or consider.

She entered into a "marriage of convenience". Was that in Thailand or UK? I presume it's in the UK.

The UK guy wants cash for the divorce. On what basis is he demanding money? He was unfaithful, but what happened in the UK.

She got visitor's visas for a number of trips to the UK, then fiancee's, then marriage (presumably, as you define it as a "proper" visa). After all this you say she is "still unhappy". Does this mean she was unhappy with the man and still got married or was she unhappy with the UK.

Also you indicate that she hasn't been to the UK with you but then say "plus any time she was in the uk she was living with nakmuay and didnt spend a single night without him". Please clarify.

I'm no way an expert on visas but from what you've written and your naivette regarding the visa process would predict your going to have a tough time.

I must have written that bit wrong she lived with me for 17 months in the uk and i have lived with her for one month then 3 weeks in thailand

I'm no way an expert on visas but from what you've written and your naivette regarding the visa process would predict your going to have a tough time.

I realise my naivette regarding visa's etc, but it is not something i had ever came across before, when i have had to fight in other countries all paperwork has been done by my manager and the promoters so i am here to read and learn, im trying my best.

Sounds a right tight wad. The money any guy spends getting into a relationship is IMO considered lost if the relationship doesn't work. I think you're going to have problems losing that piece of her baggage.
