Marijuana possession case..

Hello everyone I would like to share my story with you guys without being judged of what’s wrong and right cause I already know I’d love your help and your answers .. I’ve started my holidays from Greece I’m 25 yrs old student and part time barista at the same time I came in Thailand at 26 of November with 4 more fellas we went to koh Samui and then Phuket.. in Phuket we had the stupidest idea of buying marijuana from a street dealer and chill at the beach (Bangla road-patong) as soon as we bought it we went around chill and have a drink we wanted to go home but they were checkpoints everywhere they stopped us in Karon search us and found on me 3,18grams of marijuana they asked me for 80000baht but i couldn’t pay that amount cause it’s enormous they kept me 3 nights in the police station half a day at court I paid my bailout and I have to show up in court every 12 days for 48 in total so my last day is now in 28 of January and I’m freaking out cause I’ve heard people going to jail for that I’m not a regular user I know that doesn’t count but I’m an athlete that never been caught from police for something or do illegal <deleted> around I wonder if you guys actually know what’s going to happen with me cause I’m scared I don’t want to go to jail for marijuana and I know I’m brainless and stupid but I’d love to hear something positive ...btw I’m broke alone and freaked out ..

You could make arrangements to get a 30 day extension of your 60 day entry. After that you could then get a extension for being involved in a court case.

I did my extension of visa for 30 more days it lasts till 24 February but I mean in my case am I going to jail and I getting deported or sentenced?????????

You should have negotiated their offer to a much lower one.

There is a chance you could go to jail from what I know of the law. But, to answer your question why would anyone on here positively know the end result?

For that small amount of marijuana will probably only be a fine for possession.

I had an American friend in Pattaya, who got caught with a small amount of weed (like 2 joints), about 2 years ago. He wasn't rich. He was sentenced to 41 days in Pattaya prison. He was in a jail cell with about 25 prisoners, slept on a concert floor. Another prisoner, upon release, gave him a piece of cardboard for sleeping, for which he was very grateful for this gift.

The penalty for possession for personal use is widely stated as imprisonment of between 1-5 years and a fine of between 20,000-100,000 Baht, although possession of a small amount is likely to get just a fine. 

 

I don't believe deportation is automatic.

I’m really freaking out and I don’t want to go to jail guys seriously I was thinking about leaving without a passport but that will cause me even more problems and I’m really stressed ...

Just try relax mate. Not easy I know. Hopefully someone will come along with some first hand experience. Lately things seem to be a lot less draconian than years gone by.

That's understandable but you only have two choices, wait for court or negotiate something with the police, both of which will cost you.

 

You could do the no-passport escape, as some poster suggested, but I doubt whether that is easy unless you have the contacts, and that will cost you also.

I’m trying to relax but as much closer it gets as harder it is to calm down ..

I don’t mind paying it off I have my ticket money available I’ll work something out if I have my passport in my hands but I don’t think it’s enough for them ..

You are in the "computer system" now. I don't believe anything can be negotiated, except with the Judge at trial, if you have a lawyer.

 

But give it a try. You have nothing to lose.

It was kind of sort of decriminalized. May sound stupid, but: Why don't you go try to get a doctors certificate for needing it for say anxiety. Show that at the end and see if that gets you some leniency. Do you have a lawyer or are you el solo facing the inquiry officer? Is there really a court date set or is it still in inquiry stages?

And curious. why did they search you? And where di you have it on you? In all my years I have never been touched.

They told me my last day is on 28th of this month so I guess it’s the court date.. I have a lawyer but I didn’t paid him a lot cause my whole money almost went on bail ..and I have to have for living also .. they didn’t asked me for searching they searched all of us I don’t know why but the checkpoint was for alcohol and they didn’t even asked about searching I think I was stood up from the dealer from the beggiging

you will likely walk with a fine, there is very little upside to sending you to jail, especially for a relatively small amount.

unfortunately every one i know who has encountered a possession charge situation was able to negotiate on spot and pay and walk away. they all also had decent thai skills and understood how to play the game.

the one person i know who was charged and went in front of a judge and was fined 20k if i recall correctly. 

his holiday was uninterrupted and he has been back annually since, this was about 3 years ago.

he did not seek counsel, and refused the option to make it go away for 40k. 

it is highly unlikely that you will face any time. 

a fine is the normal first offer, and those who are jailed are more often than not the poor buggers that cannot afford to pay it.

How much was the bail? 50k? 100K? that will tell you how serious it may be. and what did the inquiry officer push you to do, and what di the prosecutor say to you? This will tell you a lot as well.

15k and 5k the lawyer ..

It has not been decrimalized. It is now legal for medical purpose but there is no smokable form. The prescription is easy to get but doesn't allow you to possess raw weed.

That gives me hope regardless my stupidity I took my lesson and punishment The only think I want is not being locked in a prison cell I’ll give all the money I have I don’t care I wish I could do it from the beginning .. thank you all for your attention and your positivity and fast reply’s I’m obliged and I appreciate this a lot

you are good dude, i would be very surprised if you were fined more than 20k. 

weed is a Class V drug, it should be a firm slap on the wrist, especially in small amounts.

i would run out of fingers if i tried to count the folks i know who have been caught and walked away a little poorer.

but take it seriously, alas the law is not always predictable even if logic dictates that there is no benefit to adding foreigners with minor infractions to the list. 

be as meek and respectful and contrite as you can.

what has your lawyer said?
