Prove to me how good this forum is and advise , if you can, a friend of mine who is stumped as to his options.

He is married and over 50 with a child (2+).

He cannot provide proof of funds for either marriage or retirement visas, but that is not to say he is poor, its just circumstance at the time.

He has gone to a Thai court and proven his paternity of this child.

His application on January as a father was blanked and told to reapply in 3 months for retirement, to which he agreed, but as above the funds were not available.

What to do.....only 9 days ??

Just to clarify...the money was available at the time of his Jan application, but was subsequently used. Therefore in April ( he was given a 3 month visa in Jan ) his option was to get a walk across VOE and was given only 16 days ??

Without funds the only chance for extension of stay would be the live with child if over age 50 provision and have not heard of any being approved outside of Sunbelt Asia in Bangkok.

He can likely obtain a multi entry non immigrant O visa from KL to cover the next year, (with 90 day border runs), with marriage certificate/wife id card and child birth certificate. Otherwise it would probably require a trip to Oz to obtain such a visa.

He can obtain a single entry non immigrant O visa just about anywhere to provide 90 day stays.

I assume the wife does not have 40k income that could be used?

So many options but none seem to suit his requirements apart from throwing the towel in with Sunbelt.

Surely as a legitimate father he should not have to pursue anything less than a 1 year visa, meaning no 90 day runs.

The 40 K or 65 K is a non sequitor.

I truly value your time spent answering our queries Lopburi, and I have spent ages Searching for my answer, hence my urgency in achieving a definitive reply. :o

Sorry Lop, on this you are wrong!  I personally know of several people that have been given a "live with child if over age 50 provision" full one year extension.  I was also given my first 1 month extension based on 7.17 (5) in first week of April.

I have written up a full guide, called " Extension of stay based on support of a Thai Child" similar to the big Savannakhet post I did and will post in on the receipt of the final 8 months stamp in the first week of May.

How am I wrong? I said there was such a provision but I had not heard of anyone being approved outside of Bangkok and those in Bangkok that I had seen reported were customers of Sunbelt. Are you saying these were obtained at another office? If so please say where as there are a lot of interested people in need of that information.

I personally applied (not with Sunbelt) for an extension of my Non Imm "O" that I had received in Savanakhet, at Soi Suan Plu and was given a preliminary  extension 1 month extension and have to revert in early May for the final 8 months.

I also personally know of several people that have got the extension based on support of a Thai child from Suan Plu.  It is not easy but there is a strategy which I will explain in early May after I get my final 8 month stamp.

Why wait till after may, some may need it now.

I got mine also a week or so ago, but now little worried about the month return to pick it up as I think I fcuked up on something....bugger.

I obtained an extension of stay under 7.17.(5) at the Korat Immigration Office.

Applied 9th March and got the full 12 month extension 21st March.

Thanks. That's Bangkok and Korat Immigration have accepted the over age 50 live with child provision - if anyone has submitted from another office please post.

3) will it make any difference if my wife becomes a US citizen (but keeps her thai citizenship) before we move to thailand?

Yes, i am aware of the retirement visa option, but given my "colorful" past, a police check is going to show my indiscretions (all in USA, not in Thailand).

If your child is Thai and your name is on the birth certificate you should be able to get a yearly extension with no money in the bank.

The retirement option does not require a police check.

If your child is Thai and your name is on the birth certificate you should be able to get a yearly extension with no money in the bank.

The retirement option does not require a police check.

Qualifications of an applicant

1. A foreign national whose age is 50 years or above. (on the date of submitting the application)

2. Not being prohibited from entering the Kingdom under the Immigration Act. B.E. 2522 .

3. Having the nationality of or the residence in the country where his/ her application is submitted.

4. Having no criminal record against the security of Thailand and the country of his/her nationality, or the country of his/her residence.

5. Not having prohibitive diseases as indicated in the Ministerial Regulation No.14 (B.E. 2535)

(Leprosy, Tuberculosis [T.B], Elephantiasis, Drug addiction, Alcoholism, 3nd step of syphilis)

a further search indicates an FBI clearance is required.... as noted in other threads, this is even true now for teaching.

I applied for the "over 50, live with Thai child" visa by myself in Bangkok. No problems whatsoever, no "extra" documents required, the Immigration officer was very helpful, and the 12 month visa was issued after a 3 week wait.

The only thing I can add is that they told me if the child is over 15 years old, Immigration will want them to come along to sign a statement. I have two boys (twins) who just turned 15 and an 8 month old daughter, so the officer advised that next year I should apply using only my daughter's birth certificate to make it easier.

this is all very good news to me.

One last thought: has anyone done it where the child is born in USA?

Like i said, our 3 yr old has a "thai" birth certificate, as that was necessary to get her a thai passport. We will be putting on the wife's housecard next trip to thailand and get her thai ID at the same time.

Just wondering if that little wrinkle of being born in USA will matter. We will all be living in Thailand, so i don't think it should, but no one asked me before they made all the rules!

That, or any little iffy might well matter. At least one office seems to rule any child under age 20 does not count.

But with 45k monthly income you can qualify to extend your stay on a yearly basis to live with family.

You can obtain a multi entry non immigrant O visa but that will require 90 day visa runs.

With difference between 45k and retirement 65k in Thai located bank account for 3 months you can obtain retirement extension of stay inside Thailand. That does not require medical or police check.

I replied to your other post, You keep saying support of thai child

that is the old extension and needs 400,000 in the bank and u need to have had it BEFORE last october so ur grandfatehred in.

New one does not mention support at all but merely a thai child

IF u had to have your thai wife there to sign something and as u said you got your extension before on mariage and you showed 400,000 in the bank that is the one they gave you.

Look at your visa and tell us all exactly what is says after the Type "O"

I will get mine with 500,000 in the bank here in phuket NO WIFE. no marriage child is mine by birth and court decree and same day/ All extenions for thai wife or the old one SUPPORT thai child they give u 1 month extension then you go back

All retirements extensions are given same day as whatever office ur at for 1 year

What people do you know that obtained this new extension without there wifes signing??

On another thread, I requested for a PM in case you weren't ready to share the process. However, seeing how many others, too, have had success with this option, it would help those of us wanting to do the same. I'd ask the same of the other posters, too -- what was the actual paperwork required? Anything additional needed to what Sunbelt noted? Which office and section did you go to? It appears that even Suan Phlu wasn't helpful to at least one person when they came cold calling for this information.

Any additional details (even just anecdotal stories) would be great.

Would I be eligible for the "Live with Thai child" if they are my step-child? :o

Btw, my wife and I plan to be in Chiang Rai (her hometown) this June and July '07 to visit family and look for property.
