Hi all,

I have read through some topics on thaivisa for information, guideline and comments about settlement visa (spouse) in the UK, but seem like there is not any case similar to mine. So, I made decision to post my case herein. I would be appreciated for any suggestion, please kindly advise

I am 29 years old, Thai nationality. I have been married British citizen for 2 years and we have been living in Thailand since. Recently I went to the UK for few weeks with C-visit visa and the visa will be valid until September 2007.

I would like to know what I should do to apply for spouse visa. Should I apply in the UK or in Thailand, which one is easier? The immigration officer in Cardiff, South Wales told me that it would be quicker to do it while I am in the UK. If I apply it in at British Embassy in Thailand, how long will it take to do so? Do I have to wait until my C-visit expires before I apply for spouse visa? I am not too sure if I could apply for new visa, settlement one, when the C-visit is still valid. And if I apply it in the UK, how long will it take? How early do I need to apply before my C-visit visa expires?

Please correct if I was wrong, from the information that the British embassy in Thailand provided, seem like my husband should be living in the UK or have a place where we will stay and he should also be working there to prove that he can support me without recourse to public funds. As I mentioned, we have been living in Thailand. Obviously, he is not working in the UK and does not have a place to live in the UK now.

We plan to stay at Cardiff, South Wales. We have bank account in my name in Thailand. How much money should be in my account to support my application? Will it help if I provide my personal detail such as education, career etc, I gained a Bachelor and Masters degree's in chemical engineering and I currently work as senior process engineer for international company in Thailand, I also hold a 10 year Business American visa.

Right now we are in Thailand and plan to go to the uk at the same time once I get the spouse visa, Do we still need to show the officer where we will stay? Is it acceptable to get his aunt being our short term sponsor?

Could you please advise what I should do to prove that we can support ourselves? and what documents I need to supply?

Hi Beatniker,

I don't know why the immigration officer at Cardiff advised you to apply from within the UK, because, except in compassionate cases, it is not possible to change a visit visa to a settlement visa whilst in the UK. So, you should apply for a settlement visa at the British embassy in Bangkok before travelling to the UK. Although you have a valid visit visa, this does not prevent you from applying for a different type of visa, and the application form can be found here.

You will need to show that you are married, you have somewhere to stay, you have either enough money or a job to take care of yourselves without claiming public money, and that you intend to stay together permanently. Your husband's aunt can be the sponsor. If she will be providing accommodation, she should write a letter to the visa officer in which she explains how big the property is, how many other people live there, and that she is happy for you and your husband to live with her. She should also provide evidence of her rental/ownership of the house. If either you or your husband can find a job offer before applying for the visa, then so much the better, but the visa officer also has to take into account the ease with which either of you will find employment in the UK, and as you have a degree in Chemical Engineering, you should find a job relatively easily. If your husband's aunt is to financially sponsor you until such a time as you become financially independent, she should provide evidence of her ability to do so.

Your visa application must be made from country of origin, they will be mainly interested in your husbands ability to support you there are a lot of knowledgable people on here, wait for more replies

Many thanks for your comment, the scouser.

I am looking for a job in Wales now, and got some emails from agencies asking me for interview. But main thing that they concern is I can not work there legally now, said they have to talk with employer seriously about it as it's quite difficult to get the invitatioin from employer without work permit. Do you have any suggestion ?

Explain to them that if they offer you a job you won't require a work permit as your husband is a British citizen and, as such, you will be allowed to work without restriction.
