What are the legal binding warranty periods for construction work and associated equipment in Thailand?

 

I heard that structural defects is 5 years?

 

Reference to the corresponding Thai legislation would be appreciated.

Warranty is five years for a structure and one year for non-structural parts.

Consumer Protection Act B.E. 2522 (1979) and the Royal Decree Prescribing Bases and Procedures in Relation to a Business that is Subject to Contract Control and Description of a Contract B.E. 2542 (1999).

If local village handyman's build house warranty is as far you see taillight !

Basically until your last payment is made. If it’s a big company you may get some things covered. But legal binding? A judgment against someone with no assets?

 

Big companies guarantee products, small, not so much.

Good luck getting any at all. My "builder" has no money so what am I going to sue for?

Depends on how much retention you hold on them and for how long you negotiate to hold it!

When I had my little Resort built, I told the builder there would be a 10% Retention Fee for 1 year.  If anything happened, the cost would be taken out of the Retention Fee if he did not fix it.

I got a one year warranty on my house from my builder, the roof started to leak, yes he fixed it, after i had paid for the numerous amounts of expensive frigging silicone for him to use. It just wasn't worth the argument.

I was told the house I am buying had a 5 year warranty  by the agents, but now  just before I have to pay my full 10%  I find that it's only one year!

But I had nothing in writing from the agents so I can't prove that I was mislead.

This bothers me a lot, it was the main reason for buying new build
