Divorce Case In Thailand

Mind you not MY divorce case but my closest friends.

I am assisting him (free) as I have delt with laws and regulations in my previous working life.

What i have discoverd in dealing with "shady" and (NO) lawyers in this case and others is shocking.

First of all

Marriage registration in thailand.(many but not all people know)

Anyone who registers his marriage in Thailand will revoke all his rights of claiming anything such as payments and investments in thailand(when you sign!!)

Secondly i discoverd that there are many cases where the thai spouse registers the marriage AFTER houseregistration !!!!!!!!!

so in other words.........first things first....complete all the things you are "giving" her like

house....land...etc etc and THEN register.

You see in that way regardless if you sign or not you are legally NOT married according to Thai family law and thus all rights of claim on land and/or proporty is useless.

and sinds almost everybody signs at the Amphur when they register their marriage its as simple as this........................nobody expect Thais OWN or can CLAIM anything in Thailand

its regarded as gifts outside marriage.

regardless where you maary in or outside Thailand.............

Prenuptial in case of outside Thailand marriage...is called ANTInuptial in thailand

No foreign law can apply on this subject in all cases if you as a farang go to court.....in case of the THAI spouse goes to court its a diffirent matter, but not yet clear to me.maybe somebody can explain me

another thing

Ihave discoverd that (same in Laos) socalled international law offices usually work with unqualified lawyers( again its the illusion.)and a bunch of school kids behind computers to translate and answer e-mail.........just a frontdesk for A company WITH a qualified lawyer......so in fact your speaking with a ???????what????? for 5000 bath an hour and you still end up with nothing.....mind you NOT in all cases but in many.

Whats bottering me is that its all been part of the culture" and widely accepted, no court of appeal as far as I know.

Only the foolhardy are blind to the loss of "rights" when "owning" things in LOS.

I first heard it here:

If it floats, flys or F**ks, RENT IT!

I think that can be extended to "if it costs more than you are will to give away.."

It seems to me a foreigner has several choices when married to a Thai.

First, one can take the approach suggested by Loz and be ready to walk away from any assets acquired in Thailand.

Second, one can spend real money on a reputable law firm, such as an international firm in Bangkok, and then one can also get one's own reputable lawyer that one finds in one's own country to review what's told/decided/done. Then one can have some reasonable expectations about what would happen in the event of a divorce.

Would be interested if others disagree, and believe lower cost lawyers in Thailand without any offshore overwatch is reasonably sufficient to protect assets?

it must have been a slip of the pen.......see.........

what any HuMMMMM "Western" lawyer could tell you in 20 minutes it takes a mathematic like me...Uh Uh..to figure out how to get the THai lawyer to explain to me something that is

1. not already known (on every wbsite availble)

2. To get to the point....if any for that matter.

3. and when they finaly GET to the point it doesnt make sence.

What do you mean. . "go to court if you dont have a case"....????

in the end you pay just as much as in the good old west, but with less or no expectations at all!!!

by the way......................

if yougot assets that you dont want to lose dont marry a thai.

rent em like loz says.

rent a girl and you get a free family too. or you can buy(marriage) but more expensive, free family still come s with buying

you know mama papa, brother withbroken motobike, drunken uncle, pet buffalo.

what do guys give their girls

to keep the families at bay? i know it happens but dont know the amounts. please enlighten me.

"Facts" don't resolve legal problems. One must apply the "facts" to the "law," and this means one needs to know the law. Are you saying you know Thai law and can read and understand the Thai laws as written? What are you saying? Is the use of mind altering substances in play?

Thailand is suing Utube...... do you really think a lawyer from this country could help?
