My fiancee and I are preparing to be married. She is concerned she will lose the right to buy and sell commercial real estate if we register our marriage in Thailand. I cannot find any information on this subject. She claims she will lose her right to buy and sell property due to the fact I will be a part owner of the property if we are married, or something to that affect. Is there any truth to this?

She won't lose any rights but whenever she buy land you will have to come with her to the land office and sign a document stating that you don't own or have any claims on the land and that the money used to buy it is hers only. So if this is something she does frequently you will spend a bit of time at the land office.

You won't get your name on any title at all. She'll have a lawyer, so go and get some advice that is specifically appropriate to your particular situation. In essence, the lady does not lose any of her property rights by marrying a foreigner.

Take her to a lawyer, and sort things out. She possibly knows the old rules and maybe unaware of the considerable changes in this aspect of Thai law over the past several years.

It is true, she is able to buy property always. Married with a forang is no problem. If you want to be the owner of the property too, I recommend that you both build a company, the most of the shares of the company have to be in Thai owernship by the law but they can be eliminate by certain contracts stated between you and your wife so that even she would have the most shares of the company you would have the maximum voices. The company would buy the land and also be stated as the owner within the offical land office. A advantage of this: TAX savings in future if you like to sell the property. You will then not sell the property, you just sell the shares of your company or the company itself and with it the property.

OK so I am a little bit slow. But what pray tell, has Bali got to do with Thai property investment ?

I'd guess the marriage (or not?) of Mick Jagger and Jerry Hall. He denied it was valid when she brought divorce proceedings.

Perhaps this lady is getting prenuptial cold feet, and is starting the gentle process of withdrawing from the situation.

Well, after considerable counsil, she has been convinced. Actually, I don't think it is cold feet....she just wants to take a Holiday I think. Looks like immigrant"O" and marriage in Bangkok for us.

Once you are married, and if it is your wish, you can apply for a work permit on an O visa with the cooperation of an employer.

Yep, Thai Constitution states that EVERY Thai citizen has the right to own land in the Kingdom. Just because she marries a foreigner does not mean she is no longer a Thai citizen.
