Emergency Decree does not contradict any Constitutional law, the Thai Court says

National – The Constitutional Court has voted that the “Emergency Decree” is not contrary to the Constitution.

The voting followed an objection from pro-democracy activist Piyarat “Toto” Chongthep who requested the Constitutional Court to consider whether Article 9 (2) and Article 11 (6) of the Emergency Decree are inconsistent with Article 32 of the Constitution.

The Constitutional Court then held a meeting on Wednesday, June 1st, to discuss the matter. The Court, by a majority result of 8 to 1, has ruled that Article 9, which prohibited large gatherings, and Article 11, which granted the authority to the Prime Minister to urgently order the prohibition of any actions that could be threatening to the security of the state or the people as necessary, are not contradictory to Article 26 of the Constitution.

Of course if you have judges that are not independent but in favor of the Government , there will never be anything against any law... Justice must be reformed... with really independent judges and maybe just as in several other countries a judge panel of common people...

It is all irrelevant. This ruling cadre arrived using guns, arrests, attitude adjustment and more violence against innocent citizens, and they will do whatever they think necessary to maintain their definition of public order. Covid provided them with a shield to hide behind and they will not give up the Emergency Decree even when the disease becomes endemic. They might delete it in its current format but it will reappear under another disguise because these rulers see that a future election will result in their demise, a situation they will not allow. 

Anyone thought different can go back to their own country!!

Funny things, constitutions really.

Some are almost written in tablets of stone, virtually impossible to amend; others are about as permanent and tangible as squirting your initials in a sink of water with a washing up bottle of washing up liquid!
