Hi,

 

I got a work permit with a non O immigrant visa based upon marriage. I have to renew my visa end of August, I will probably have only 1 month salary to show, almost 2 months and that's maybe not enough.

I would like to switch to business visa, do I have to redo my work permit or can I keep this one?

The company that is hiring me has a registered capital of 1 000 000 bahts only and with a business visa it's supposed to be 2 000 000 bahts.

The agency I used to get my work permit is saying that it doesn't matter and I can keep my work permit so I would like to double check here.

There is 2 reasons I need to switch first I'm not sure to get the 2 months salary required, second my wife is blackmailing me with this and hold my life.

She left me few months ago for a rich guy (that she married at the temple, fake marriage) then we went back together but she is still with him too, she comes to stay with me and my daughters around a week per month. I have to please her and accept everything, play love.

It's emotionally exhausting and depressing, I really wish to respect myself again but my life is here, my job and career and my children.

So with a business visa, I could be independent, pay my debt and start my life over. I could take a lawyer and protect myself as she would probably take back the kids and ask me more than 30 000 per month that's half my salary to take care the kids. She is making a lot of money with her boyfriend and her new business, really a lot so I don't see the point in asking me that much. She also got a car a land and a house that I paid and build through many years. 

For now she is all sweet, we have happy family week-ends and I close my eyes when she calls her boyfriend but damn it's painful.

I wish we could stay just friend and get my freedom but she won't let me having a girlfriend when I have the kids, as she doesn't want another woman to replace her and don't trust a stranger to live alone with the kids and I have to agree with her on this. When she speaks about getting the kids back I agree but she immediately continue by I should pay her more than 30 000. I know that it's probably not the law but she is the key to my visa.

So a business visa would mean I can tell her nicely to <deleted>-off and start my life over. For now I have to seduce her and make her happy.

By the way that would be another question, if I divorce after getting the marriage extension would it cancel the visa as soon as the divorce process start?

Would end when divorce is granted.

So it would worth it to get the marriage visa end of august, and then I won't need her every 3 months for reporting? We already changed my address to where I work.

and once I start the divorce process she can't just go to immigration and tell them we are not together anymore and block me?

Have you considered the "parent of a Thai child" if under 18 yo ? I am not sure about the requirement, maybe the sames as the marriage visa.

Look at the thread from UbonJoe, i think he is almost the absolute reference about all these visas problems.

Are sure that you can qualify to apply for a extension of stay based upon working. It appears you salary may not meet the income requirements. You need a minimum salary of 50k baht a months if from most western countries.

A multiple entry non-o visa based upon might be your best option. Just do a border hop every 90 days for a new entry.

You don't need her every 3 months.

Your extension is also valid until your divorce is finalized (or until the extension expires), if you want to prolong it you could contest it.

My salary is 70 000 per month, with free accommodation but indeed I forgot that they reopened the border so that would be one more possibility. Again here she can't cancel my visa by just going to immigration and stating that we are not together anymore?

If like this I will leave her after getting the extension or a multi entry.

Maybe I should avoid making kilometer of my story but for some reason it feels good to share, thanks for having the courage to read all.

You don't switch visas. When your extension for marriage ends you just apply for an extension for working. You keep the same work permit.

If you want to clear your situation now, and can afford to take 2 or 3 days off, you could make a trip to Vientiane (leaving Thailand cancels your current extension, unless you have a re-entry permit), and then apply for a non-B visa at the Thai embassy there. Two months later you then apply for the extension for working.

I don't have an extension now, I have 3 month non O that will end at the end of August. So at any time before the end of my current visa I can go to make a business visa and keep my work permit. I can also try to get a marriage extension or a multi entry if I can support to be a cuckold a bit longer and then go to make a business visa once my Non O end or even before.

In all these possibilities I don't need to do anything regarding my work permit, as long as I work and have a valid visa it's ok right?

Ah ok, I assumed you are on an extension for being married.

In this case just apply for an extension based on working at immigration, there is no need to change the visa.

The work permit and visa are (mostly) separate issues. If you did not have a work permit, an extension of stay based on working would not be possible. However, the end of your permission to stay based on marriage does not automatically terminate the work permit. If an agent can get you an extension based on working (I am a little dubious on that) the work permit should not be a problem.

 

On the divorce with kids involved, it will be a real mess, but probably not as bad as if you were in most Western countries. You ought to support the kids, even when the divorce goes through, so do not expect it to be a benefit financially.

How she could force me to pay? she left me for a rich man, got the land house and car I paid, <deleted> with him in the house I paid and the bed I bought and we slept for 7 years. She has way more money than me, firstly because she own everything I paid and work for secondly because her very rich boyfriend is spitting ton of money every now and then. She bought a second hand pick up that she sold for 300 000 then he just bought her a new car (struggle to put the credit in her name) with a 600 000 down payment. She has a plastic shop and a massage shop now.

The kids are still with me and she never paid anything for them, when I was struggling she got a marriage ceremony with her boyfriend and he spent 200 000 for it and gave her 60 000 in gold. She didn't help me for school or for the doctor or anything for the kids, having a beautiful dress and a nice wedding ceremony was more important. So unless thai law require me to give half my salary to an unfaithful wife I don't think I should help.

Do you have an idea of how much I'm supposed to pay in alimony?

I still hope that a lawyer could help here, I will take one soon, I wait to see where it is going. Right now we are like lovers, or husband and wife and I'm super cuckold I don't know.

I have many pictures from her facebook of her wedding ceremony and a video where she explains she left us to have fun and happy life.

You take care of the kids so you don't have to pay child support, she gets nothing.

Its a one day deal here. You just go together to the amphur office and divorce. Its over. 'A good mate was separated for a year. One day they decided to end it, the next day it was over. Picture is "the end"
