Hello again,

I had asked a similar question more than 6 months ago and didn't look much into it since then(been around quite a bit), I would like to know how things are these days in this particular case.

My question and situation for the time being:

I am a 31-years old german officially married to a 34-years old thai woman, currently I am on a 3-month Non-O visa here and i don't work here but we plan to stay here and for the time being the situation is as follows:

She works here and makes around 180.000 THB / month in her job.

So the question now is whether that still enables me to apply for a 1 year visa(one where I don't have to leave the country that can be extended at the immigrations) and show HER salary (or bank account) or whatever is necessary?

I have heard that lately the law has changed and now also the thai wife can show her money to get the visa for the farang hubby.

i have also heard that the 400.000 THB bank deposit is not possible anymore(which we didn't want to do in the firts place anyway but still...)?

The only question I've is the tax she has to pay for this income, and how long before...

She will have to go with you to Immigration with last years tax paperwork and normal marriage proof (certificate/photos and such) and there should not be any problem getting the one year extension of stay. There is no requirement for any bank account with 400k and you are right it is not an option anymore for new applicants.

as for the tax, well she has been officially working and paying tax(something like 30-40.000 THB / month if i remember correctly) for various companies in the last 10 years in Bangkok, in her current company since about 3 years. She has already asked for the necessary tax documents for this, basically no problem but the company is a bit hesitant to hand out the Phor Ngor Dor 1(or the other one, not sure, I don't have my documents here at the moment) as it apparently contains every employees' tax records and is therefore confidential.

Thanks for the answers and confirmation, we will finally go to the immigration soon and see what'll happen,

Basch, yes, you can apply for annual extensions of stay based on your wife’s income. Immigration usually wants to see the wife’s income tax receipts for the past three months. From paragraph 7.17 of Police Order No. 606/2549:

(6) In case of the applicant who is married to a Thai wife, one of them or both of them need to have the total annual income that is averaged out not less than 40,000 Baht per month.

I'm Malaysian, age 29 and holding Non-Imm-B visa with work permit.

I'm married to a thai man recently. I have lived and worked in Thailand for about 6 months now. I would like to apply for the Non-O visa but i need an annual tax form? My husband's income is below 40,000 baht/month but my income is above that.

Does that mean I have to wait for one year (to get my annual tax form) before i can apply for the Non-O visa?

If you were a man and married to a Thai wife, its in most cases proof of the last three months ( PND #1).

In your case as you are a woman married to a Thai man, no proof of income is required for your Thai husband or you are required to provide proof of income to get the extension of stay permit based on being married to a Thai national.
