Bankruptcy Department Addresses Chemical Leak at Abandoned Factory in Rayong
The Department of Legal Execution on November 21, provided clarification on a chemical leak from an abandoned factory operated by Nirun (Thailand) Co., Ltd., which had ceased operations over a decade ago. The incident, involving chemicals seeping into water sources, has sparked outrage among local residents in Ban Khai district, Rayong. The factory, previously engaged in citric acid production, was placed under a bankruptcy ruling by the Central Bankruptcy Court on October 26, 2022. All assets, including land, buildings, and machinery, are currently under the control of a court-appointed asset custodian. However, attempts to auction these assets have been delayed due to creditor disputes, with a key hearing scheduled for November 26. Residents have long expressed concerns over chemical residues on-site. Initial investigations revealed stored chemicals in deteriorating plastic bags exposed to weather conditions, raising potential health and environmental risks. In response, the Department coordinated with local authorities to relocate these materials to a secure location. A recent spill reportedly occurred after individuals unlawfully entered the factory, dismantling machinery and structures. This damage led to chemical leaks, particularly from gypsum residues, contaminating the factory grounds. The Department has taken initial measures, such as using sandbags to contain the leaks, while collaborating with the Pollution Control Department to assess contamination levels. Samples collected on November 18 are under laboratory analysis, with results expected within 3 weeks. The Department is expediting efforts to resolve the issue. This includes: 1. Conducting a full inventory of remaining chemicals. 2. Selecting certified waste disposal firms to remove and treat hazardous materials. 3. Strengthening security to prevent further trespassing. Additionally, creditors and stakeholders, including the Rojana Industrial Park, are being consulted to determine comprehensive cleanup strategies and costs. The next creditor meeting is scheduled for December 25. Penrawee Masang, spokesperson for the Department of Legal Execution, emphasised that the Department is fully committed to mitigating the situation. “Despite legal complexities, we are collaborating with relevant agencies to resolve the issue and minimise the impact on the community and environment,” she stated.
