Dear all forum members,

Thank you first of all for sharing your insight into various visa issues. I read up on a few but it's like, the more I read, the more I don't know. :o So I think it's best if I start a new topic here.

I have worked in Thailand for 6 months, with proper Non-Immigrant B visa (1 year) and work permit. I am age below 30 (so we're not talking about retirement visa here). My income is above 40k Baht/month. Last month I married my husband who is a Thai nationality. We registered in Thailand.

I have been doing border runs every 90 days, twice already. I don't want to do the border run as it is quite inconvenient for me. I want to be able to report my address at the immigration office (at Suan Pluh, for example) every 90 or 180 days.

My questions. Can I:

(1) apply for extention of stay based on marriage (without Non-O visa)? Do I have to make border runs on this kind of extension?

(2) Since I am a woman, I was told that I do not need to show any proof of income of my husband. What about my income (since I'm working)? Do I need to show the annual tax form (i can only do that at the end of the year as I have been working only for 6 months and this is my first job)?

(3) hold a Non-B AND Non-O visa in parallel?

If suppose, I keep using Non-B visa for the next 5 years and then decide to apply for PR in Thailand. Is that possible? Or I must have Non-O visa for a certain number of years before I can apply for a PR?

You should be able to convert your existing B visa to an O and then get a one year extension based on your marriage.

As a woman there is no income requirement.

The O visa also allows you to work.

1. You can apply for extension of stay on basis of having a Thai husband and you will not have to make border runs. He will have to be with you when you do this.

2. No income required.

3. You do not hold two visas - you will extend for marriage (am not sure if that will require a change in visa status but believe any non immigrant entry can be used). There may be new work permit criteria to follow but you do not have to have a B visa to work.

As for PR the rule is 3 years on extensions of stay (type of visa entry is not a factor). But being female there is a direct path to citizenship open if you are interested in that. From some locations it is easier than from others (due to local administration conditions).

From my understanding, if I do not apply for extension of stay based on marriage, then I still need to make the border run every 90 days with the Non-O visa?

I am malaysian. Must I get the Non-O from thai embassy in malaysia, or I can apply from Thailand?

Things are clearer now. Do you know if it is possible to hold double-nationality (Thai and Malaysian)? I think my children next time they can have double citizenship but what about me? :o

You may have the choice to extend on the basis of marriage or job. Many jobs do allow extensions of stay. But it is better to use the marriage basis as if you lose your job/or change, you will not lose your extension of stay if done on the basis of marriage. Also there are a few more prospects for employment if married (due to slightly different requirements on the company hiring).

If you do not extend you will have to make 90 day exits/entry and re-new work permit each time.

I do not believe you will require a change of visa but if you do it should be available from Immigration (if you can meet the requirements which may not be the same as the no income marriage extension). Worst case would be a quick trip to Penang or KL to obtain using marriage certificate.

If i understand correctly, it is possible to apply for the extension of stay based on marriage while holding the Non-B visa? Excellent! :o
