Lawyer Not Afraid Of Senators Suing Him For Defamation

A LAWYER who is facing a defamation lawsuit from some senators over criticism of their performance during the joint House/senate meeting last Thursday (July 13) where only 13 of them voted for Move Forward leader Pita Limjaroenrat as prime minister said he is not afraid and is waiting for them to do so, TV Channel 7 said Monday afternoon (July 17).

 

Mr. Decha Kittiwittayanan posted a message saying, “Reporters told me that senators, who were not elected by the people, threatened to sue me. I am waiting for them to sue and will file a countersuit.

 

“Their salary comes from people’s taxes so people have the right to criticise them.” 

 

He later said he has heard that these senators and their lawyers are now collecting evidence against people who criticised them and are going to file a lawsuit tomorrow.

Yes, it will be a fine day indeed when Thai politicians, government officers, the army, the police et al recognize this. It seems to me many of these groups view it the other way around and that the public is there to serve them and enable their own status and enrichment. 

MMM I hope this Lawyer doesn't decide to have a stroll down the banks of the Mekong.

Senators are public servants and are therefore subjected to criticism period. As public servants, they can't ignore the public. They should be respectful to the people and not the reverse. Shut up senators and be thankful that you been  paid by the people.

The use (or misuse) of defamation law in Thailand has done - imo - far more harm than any good it may have been designed to do. It appears - at least in my unlearned view - to be rather like a civil version of the lese majeste law, about which I perhaps should not say any more. 

 

(But as I said, I am no expert in matters of law and do concede that many other countries do have defamation laws. I wonder if it then depends on how the laws are applied & executed.)

If the Senators have been elected on behalf of the people then rightly they should follow the large majority of the will of the people.  I they fail to do so, without justification, they are not representing the people and should be removed from the appointment of Senator, in my humble opinion.

Threatened by unelected hooligans. That is rich. They are nothing but weak, pathetic, cowardly, self entitled, lowlife creeps, who are accustomed to a perch atop the ivory tower, scared to death of being taken down a notch, and being asked to be accountable for their heinous and unforgivable actions. Of course they will resort to whatever dirty tactics they can. That is who and what they are. Filth. They are the deplorables.

 

It is great to see the people ignoring their callous threats of legal action. Call out the lowlifes, call out their business interests, boycott them in whatever way possible, shame them and their entire families in whatever fashion is possible. They richly deserve that.

The aristocracy is so thinned skin here.

great way to spend tax payers money. they should be sued for wasting tax payers taxes

I believe Thailand is one of the only countries that put defamation into criminal law, meaning you can be jailed. Usually it comes under civil law, meaning you have to pay money if you lose.

Yes, a legacy of Thai feudalism, Sakdina and The Law of the Three Seals, all integral to the Thai Social Contract.

 

That is why one's position on the Thai social pyramid is so important.

(1/2) Junta-appointed senator Porntip Rojanasunan said Tues she won't be voting for any PM candidate because she doesn't believe senators should have the right to vote for PM. Porntip added her daughter is a MFP supporter & tried to convince her to support the party.

 

(2/2) Porntip told her daughter, "politics is politics". Unknown to some MFP supporters, her daughter was attacked online after she failed to vote for Pita. The senator said her concerns is for nat'l security as young Thais are being "brainwashed" on social media.

Thailand is unusual in that the truth is no defence. Loss of face trumps the truth in Thailand! These laws need urgent revision if free speech is ever properly allowed in Thailand.

But they were not elected in any way shape or form. They were appointed by the Thai military......makes your post mostly redundant.

At the End of the day the Military run Thailand they will not give it up fairness is not an option. They took Demcracy by way of a coup, when they knew an election was a way to oust them they rigged the voting system to remain in power. They will do the same next week thev'e already rigged the Politicions in there favour already, and threatened anyone trying to reverse there decistions.

All I can say is set up. Defamation fund for anyone who has the balls to use their voice in condemning the woeful inaction of the senators. Let’s see how they react to a tongue lashing that in a public forum
