Judge says CNN’s use of ‘Big Lie’ regarding Trump isn’t defamation

A federal judge in Florida on Friday dismissed a $475 million defamation lawsuit former President Donald Trump brought against CNN that accused the network of defaming him by using the phrase “the big lie” and allegedly comparing him to Adolf Hitler.

District Judge Raag Singhal, a 2019 appointee of Trump’s, said that use of the phrase or similar statements are opinion that don’t meet the standard for defamation.

“CNN’s use of the phrase ‘the Big Lie’ in connection with Trump’s election challenges does not give rise to a plausible inference that Trump advocates the persecution and genocide of Jews or any other group of people. No reasonable viewer could (or should) plausibly make that reference,” Singhal wrote.

“Being “Hitler-like” is not a verifiable statement of fact that would support a defamation claim,” Singhal added.

The lawsuit is one of many Trump has filed against media outlets, including CNN, The New York Times and The Washington Post, objecting to coverage during his presidency and in the aftermath of the 2020 presidential election he lost to Joe Biden.

Trump had accused CNN of a “campaign of dissuasion in the form of libel and slander” and of creating a “false and incendiary association” between him and Hitler.

“Like Trump and CNN personalities … the Court finds Nazi references in the political discourse (made by whichever ‘side’) to be odious and repugnant,” Singhal wrote. “But bad rhetoric is not defamation when it does not include false statements of fact.”

Interesting, seeing as Trump used the same term after his election loss:

Trump Says He’ll Appropriate ‘The Big Lie’ To Refer To His Election Loss

Former President Donald Trump on Monday announced he’ll begin to use the term “the big lie” – commonly used by his critics to describe his baseless election fraud claims – to refer to the 2020 election results, a sign he has no plans to tone down his rhetoric as one social media platform adjudicates his suspension.

In a statement sent through his political action committee, Save America PAC, Trump incorrectly blasted his loss in November as “The Fraudulent Presidential Election of 2020” and said it “will be, from this day forth, known as THE BIG LIE!”

Why did he sue them for that? Surely ALL MSM from CNN to Politico should be sued for falsely and without evidence claiming that he colluded with Putin to cheat in the 2016 election. Clearly defamatory, and was clearly BS from the gitgo.

Collaborations between the dems and alphabet agencies misinforming the public about a candidates corrupt activities before an election should also be worth suing them all for. Interference in free and fair elections to help one side win is bad, isn't it?

Manafort was convicted for conspiring with the Russians

Trump must be getting sick of all that winning by now.

Right.  Of course you can't give us a single sourced example of these false claims by the media companies, but you continue to insist it's true.

It appears from world sources, not just the US press, the so-called "enemies of the people"  (Trump ad nauseam) that apart from multiple conviction of Trumps henchmen (we know a whole list of names and open convictions of them for collusion and treasonous dealings with Russia) that new connections and evidence of Trumps treason going back to 2016, as a candidate for President are being mapped and evidence collected.

If the legal pundits across the globe are reading what is being surfaced correctly will from these multiple sources who have evidences that have and are being to be given to the FBI and DOJ likely see further Federal charges against Trump and his minions regarding espionage, and treason.

Where did their news departments make this claim? And as has repeatedly been pointed out, Mueller said that if Trump weren't President he could be charged with obstructing justice. As in holding out the possibility of a pardon to parties such as Paul Manafort who did engage with Russian intelligence agents before the elections. Fortunately, it turned out that Trump would never engage in such an obviously corrupt practice. Or maybe he did.

Trump is such a chump. He defames and lies about everyone and everything, then cries foul about CNN calling his GARGANTUAN lie "The Big Lie". CNN actually toned it down.

The guy is an infantile, corrupt, narcissistic, lying, cheating, projecting, foul, spoiled petulant a-hole brat...and LOSER. ????

Other than that how do you feel about him?????

I would just like to re-iterate that this judge is a Trump appointee. As Glenn Kirshner so often states “Justice matters”.

He should had let the case go to trial, that way trump would have to prove that it was a lie.
